From April 29, 2019, to May 4, 2019, Thu Ky Luat has updated numerous new documents on customs, education… Noteworthy documents include the following:

1. Content of management and use of collected customs fees

Recently, the General Department of Customs (GDC) issued Decision 1157/QD-TCHQ on the promulgation of the regulation for the management and use of customs fees.

Annually, the provincial/municipal Customs Departments shall develop an estimate of customs fee revenues and expenditures to be submitted to the GDC for appraisal and overall incorporation into the State budget revenue and expenditure estimates for submission to the Ministry of Finance (MOF).

Based on the estimate assigned by the MOF, the GDC will allocate the customs fee revenue and expenditure estimates to subordinate units.

Note: The unutilized customs fee amount at the end of the year shall be carried forward to the next year for continued usage in accordance with the prescribed policies.

For the customs fee revenue exceeding the allocated expenditure estimate, the provincial/municipal Customs Departments must remit it to the GDC for centralized management. The Customs Departments must report the actual customs fee revenues, annual customs fee expenditures, and propose the usage plans for the excess fees mentioned above, along with the year-end balance report as guided annually by the GDC.

2. Official Dispatch 1735: Coordination of the 2019 National High School Examination

On April 24, 2019, the Ministry of Education and Training issued Official Dispatch 1735/BGDDT-QLCL on the coordination for directing the organization of the 2019 National High School Examination, university, and college admissions.

The provincial examination steering committee shall take full responsibility for directing the organization of the Examination in the locality. Attention should be given to the following:

- Strengthen communication efforts and thoroughly disseminate the current examination and enrollment regulations;...- Intensify the direction and inspection of completing the academic year 2018-2019 programs and plans, and organize review sessions for grade 12 students in the province's educational institutions;...- Develop and implement examination organization plans in the province to ensure safe, honest, and objective examination and enrollment;...- Allocate funds from the local budget to organize the Examination, including payment for officials and lecturers from universities and colleges dispatched by the Ministry of Education and Training to participate in the examination, proctoring, and grading;- Direct and manage the coordination to organize the Examination to ensure thoroughness, flexibility, and efficiency.

3. Tenure of customs sub-department leadership positions not exceeding 05 years

This significant content is stipulated in Decision 1228/QD-TCHQ on the regulation of appointment and re-appointment of civil servants and public employees to leadership positions at teams or equivalent units under the sub-departments and subordinate units of the GDC, effective from April 25, 2019.

The tenure of leadership positions for each appointment or re-appointment of civil servants and public employees is 05 years, calculated from the effective date noted in the decision. Specifically:

- The time during which civil servants and public employees are assigned to act as head or to be in charge of a unit shall not be counted towards the tenure of the corresponding leadership position;- For civil servants and public employees shifted, appointed to equivalent new leadership positions, the re-appointment tenure is calculated from the effective date of the assignment, appointment to the new leadership position;- For cases of leadership position changes due to changes in the organization's name, the re-appointment tenure is calculated from the effective date of the appointment decision under the old title.

4. High-achieving athletes are given priority in employment

Decree 36/2019/ND-CP elaborates on certain provisions of the amended Law on Physical Training and Sports and officially took effect on June 14, 2019.

According to the guidelines in Decree 36, national sports team athletes, athletes of industry teams, provincial teams, and centrally-run city teams who stop being athletes and have the need for vocational training and meet the conditions shall receive vocational training support as prescribed in Decree 61/2015/ND-CP.

Especially, athletes who have won medals at the Olympic Games or SEA Games will be prioritized as follows:

- Consideration for direct recruitment into positions at public sports institutions suitable for the positions to be recruited;- Extra priority points in recruitment when having the qualifications and professional capacity suited to the job requirements;- During the probation period, they enjoy 100% of the salary and allowances of the corresponding job titles.
