Sample service contracts in administrative agencies, public non-business units in Vietnam

A service contract form for a number of types of work in an administrative agency or public non-business unit in Vietnam includes the following main contents:

- Information about service users and service providers;

- Contents of the service as agreed by the two parties, clearly stating the duration of service use and job satisfaction as prescribed in the Civil Code 2015, number of employees, working location, and other contents agreed upon by the two parties;

- Rights and obligations of service users;

- Rights and obligations of the service provider;

- Service fees, other costs, and payment methods;

- Cases of unilateral termination of contract performance;

- Argument Setllement;

- Other agreements associated with the nature and characteristics of the industry, field, and specific conditions of the agency or unit using the service but not contrary to the provisions of law;

- Terms enforcement;

- Signatures and stamps of the parties.

Works for executing service contracts in administrative agencies, public non-business units in Vietnam

Employees holding positions prescribed in Article 4 of Decree 111/2022/ND-CP shall be contracted in writing; if a contract is made by electronic means in the form of data messages according to regulations of law on electronic transactions, the electronic contract is valuable as the written contract. Types of signed contracts include:

- Service contracts under regulations of civil law and other relative laws;

- Employment contracts under regulations of labor law and regulations in Decree 111/2022/ND-CP.
