Review and arrangement of separate rooms for individuals who has the potential to try fleeing from in psychiatric involuntary treatment facilities in Vietnam

This is the content requested by the Ministry of Health in Directive 07/CT-BYT dated September 9, 2024, on enhancement of forensic, forensic psychiatrists, and involuntary treatment.

Review and arrangement of separate rooms for individuals who has the potential to try fleeing from in psychiatric involuntary treatment facilities in Vietnam

To further improve the work of forensic, forensic psychiatrists, and involuntary treatment, the Ministry of Health requests that psychiatric involuntary treatment facilities enforcing involuntary treatment measures strictly comply with the following:

- Implement reception, management, and treatment of the compulsory-treated patient according to the provisions of the Law on Execution of Criminal Judgments 2019; Decree 64/2011/ND-CP detailing the implementation of involuntary treatment measures; regulations of the Ministry of Health of Vietnam and other related legislative documents.

- Review and arrange departments appropriately to the unit's practicalities; separate those at risk of escape or threatening the security and safety of medical staff into individual rooms; arrange additional security support; install surveillance cameras; review and amend the unit’s processes and regulations to fit and be effective; strictly manage the in-and-out within departments and the treatment rooms of compulsory-treated patients.

- Actively coordinate closely with local authorities, police forces, related judicial agencies, and the patient’s family in the reception, management, and treatment of compulsory-treated patients.

In addition, the Ministry of Health of Vietnam also requires medical examination and treatment facilities to perform the following tasks in forensic, forensic psychiatrists, and involuntary treatment:

- Organize medical examination and treatment; issue summaries of medical records, injury certificates, certificates of illness and treatment, especially for psychiatric diseases, adhering strictly to regulations on professional diagnosis, treatment, examination, treatment technical processes; hospital regulations, and other related regulations.

- Heads of units, related collectives, and individuals must be held accountable if they issue the above papers improperly, enabling subjects to use these papers as a basis to request competent authorities to call for or require medical examination, forensic medicine, forensic psychiatry to avoid legal processing when committing crimes.
