Reimbursement of basic geological survey costs of minerals, mineral exploration costs in Vietnam from March 1, 2025

The reimbursement of costs for basic geological investigation of minerals, and mineral exploration between organizations and individuals in Vietnam is regulated as follows:

- The reimbursement of costs for basic geological investigation of minerals and mineral exploration between organizations and individuals is carried out based on mutual written agreement;

- In cases where organizations and individuals cannot reach an agreement as stipulated at point a of this clause, the state management agency with authority to issue the Mineral Exploitation License shall decide the reimburseable costs based on the proposal of the investing organization, individual, or the organization, the individual utilizing the information about minerals. The determination of costs to be reimbursed shall be implemented according to the provisions of clauses 5, 10, and 11 Article 3 of Decree 158/2016/ND-CP (amended and supplemented by Decree 10/2025/ND-CP).

Organizations and individuals requesting determination of reimbursement costs are responsible for paying the execution costs to the unit determining the costs to be reimbursed according to the agreement between the unit determining the costs to be reimbursed and the organizations, individuals requesting determination of costs to be reimbursed;

- Organizations and individuals utilizing mineral information must reimburse the costs for basic geological investigation of minerals and mineral exploration in a lump-sum payment before submitting an application for a Mineral Exploitation License;

- The time for reimbursement of costs for basic geological investigation of minerals and mineral exploration for cases specified at point b of this clause shall be implemented according to point c of this clause and must be paid within 60 working days from the date the Decision approving the results determining the costs to be reimbursed comes into effect.
