On November 30, 2024, the National Assembly of Vietnam passed the Law on Justice for Juvenile 2024, which includes provisions regarding educational measures at reformatory schools for juveniles.
A juvenile offender is an individual who commits a crime as defined by the Criminal Code and is between the ages of 14 and under 18 years old.
Regulations on education at reformatory schools entail compelling juveniles who commit crimes to engage in cultural education, vocational training, labor, and activities under the management and education of a disciplined educational organization as prescribed by law.
- Education at reformatory schools may be applied in one of the following cases:
+ Individuals aged from 14 to under 16 who commit very serious crimes such as: Intentional infliction of injury or harm to the health of others, Human trafficking, Child trafficking under 16 years of age, Robbery, Theft, Illegal possession of narcotics, Illegal transportation of narcotics, Illegal trading or appropriation of narcotics, except in cases where the juvenile is an accomplice with an insignificant role in the case;
+ Individuals aged from 16 to under 18 who commit serious crimes such as: Intentional infliction of injury or harm to the health of others, Theft, except in cases where the juvenile is an accomplice with an insignificant role in the case;
+ Other circumstances that necessitate application, due to the serious nature of the criminal act, the personal circumstances, and the living environment of the juvenile offender;
+ Cases stipulated in Clause 3, Article 82 of the Law on Justice for Juvenile 2024.
- The duration of implementing educational measures at reformatory schools ranges from 06 months to 02 years.
