On January 10, 2018, the Supreme People's Procuracy of Vietnam issued Official Dispatch 128/VKSTC-V3 to address issues related to the handling of activities involving the storage, transportation, and trading of "explosive fireworks" (as guided in Official Dispatch 340/TANDTC-PC dated December 22, 2017, by the Supreme People's Court of Vietnam).
The Supreme People's Procuracy of Vietnam (VKSNDTC) agrees on the following opinions:
- Apply the guiding documents in Official Dispatch 340/TANDTC-PC and Official Dispatch 91/TANDTC-PC of the Supreme People's Court of Vietnam (TANDTC) to handle acts related to fireworks;- Require the investigating agency to request specialized agencies to determine the characteristics of fireworks in cases where examination is mandatory and to conduct the examination according to the provisions of Articles 205 and 213 of the Criminal Procedure Code 2015;- Based on the examination results, nature, severity of the acts, and the characteristics of the type of fireworks, the People's Procuracies at all levels, in coordination with the prosecution agencies, will decide on whether to prosecute criminal liability or handle administrative violations according to legal regulations.
