Law Secretary respectfully introduces to esteemed members 4 prominent policies, effective from mid-December (from December 15, 2017 to December 31, 2017):
The Ministry of National Defense issues Circular 279/2017/TT-BQP stipulating the discharge of non-commissioned officers and active-duty soldiers in the People's Army. Notably, it includes regulations on the discharge files for non-commissioned officers and active-duty soldiers.
Compared to current regulations, Circular 279 specifies the components of on-time and post-time discharge files for non-commissioned officers and soldiers, which must include an evaluation of work performance. Specifically, the discharge file includes:
- Military service resume;- Military service health record;- Military personnel record;- Work performance evaluation;- Discharge decision: 05 copies (one for the discharge processing unit; one for the finance department of the discharge processing unit; one for the District Military Command where the non-commissioned officer or soldier is discharged to; two for the discharging non-commissioned officer or soldier, one of which is to be submitted to the vocational training institution where the non-commissioned officer or soldier is going for training);- Other relevant documents (if any).
Circular 279/2017/TT-BQP takes effect on December 15, 2017, replacing Circular 11/2012/TT-BQP.
This notable new point is mentioned in Circular 08/2017/TT-BNV which guides Decree 91/2017/ND-CP implementing the Law on Emulation and Commendation.
When awarding individuals and groups, the following principles must be adhered to:
- Based on the entity, function, assigned task, and achievements of the group or individual to propose appropriate awards;- Do not award multiple forms of commendation for the same achievement. Groups or individuals meeting the criteria for a certain level of reward will be evaluated and proposed for that reward by the competent authority;- Do not propose awarding two types of Orders or both Orders and Certificates of Merit by the Prime Minister of Vietnam for the same achievement;- In one year, do not propose state-level awards for a group or individual twice (except for exceptionally outstanding achievements; appreciations for lifelong contributions; or awards based on longevity).
Circular 08/2017/TT-BNV takes effect on December 15, 2017.
On November 8, 2017, the Ministry of Education and Training issued Circular 27/2017/TT-BGDDT, which stipulates standards, duties, authority, and appointment of teachers as team leaders for the Ho Chi Minh Young Pioneers Organization in public primary and secondary schools.
There is a priority for selecting teachers with talents in music, arts, sports, public speaking, event organizing, and communication to help schools organize better activities for the team and youth movements.
Additionally, teachers must meet the following standards:
- Meeting the professional title standards for teachers as per their current professional titles;- Have been trained in Young Pioneers work and have either teaching majors or supplemental training in Young Pioneers work;- Capable of cooperating with organizations inside and outside the school to organize team activities and youth movements.
Circular 27/2017/TT-BGDDT takes effect on December 24, 2017.
On November 13, 2017, the Ministry of Health issued Circular 42/2017/TT-BYT regarding the list of toxic medicinal substances.
Attached to Circular 42 are:
- List of toxic medicinal substances of plant origin;- List of toxic medicinal substances of animal origin;- List of toxic medicinal substances of mineral origin.
Note that for medicines containing toxic medicinal substances listed above and granted registration certificates still valid before the effective date of Circular 42, businesses must categorize and update information on labels and usage instructions as specified in Circular 42 before January 01, 2018.
Circular 42/2017/TT-BYT takes effect on December 28, 2017.
