On July 1, 2024, the Ministry of Justice of Vietnam issued Decision 1235/QD-BTP on the administrative procedures that have been amended and supplemented in the field of judicial records within the functional management scope of the Ministry of Justice, including guidance on the procedures for issuing Judicial Record Certificates as requested by prosecutorial agencies.
The procedures for issuance of Judicial Record Certificates upon request by state agencies, political organizations, and socio-political organizations (applicable to Vietnamese citizens who cannot determine their permanent or temporary residence) are prescribed as follows:
- Procedure steps:
+ State agencies, political organizations, and socio-political organizations requesting the issuance of a Judicial Record Certificate shall submit the application at the National Judicial Record Center in person, via postal service, or online.
+ State agencies, political organizations, and socio-political organizations shall receive the results at the place where the application was submitted, via postal service, or receive the electronic result through the Administrative Procedures Resolution Information System of the Ministry of Justice (for cases where the application was submitted via the National Public Service Portal or the Administrative Procedures Resolution Information System of the Ministry of Justice).
- Method of implementation:
+ Submit a request directly at the National Judicial Record Center, Ministry of Justice.
+ Submit a request via postal service.
+ Submit an application online on the National Public Service Portal or the Administrative Procedures Resolution Information System of the Ministry of Justice of Vietnam.
- Dossier components: Written request for issuance of Judicial Record Certificate used for judicial procedure agencies, state agencies, political organizations, socio-political organizations (Form No. 05/2024/LLTP; Form No. 14/2024/LLTP).
- Number of dossiers: 01 set.
- Time limit for dossier processing: Within 10 days from the date of receipt of a valid request. In case the person requested for a Judicial Record Certificate is a Vietnamese citizen who has resided in multiple places or has resided abroad, or in cases where verification of statutory conditions for automatic criminal record expungement is required, the time limit shall not exceed 15 days.
