New point on expenses for procedures of transporting subjects to compulsory rehab establishments in Vietnam

On October 5, 2022, the Minister of Finance of Vietnam issued Circular 62/2022/TT-BTC stipulating the management and use of non-business funds from the state budget to implement the regime of applying the measure of sending subjects to compulsory rehab establishments.

According to Article 4 of Vietnam's Circular 62/2022/TT-BTC stipulating the content and level of expenditure for carrying out the procedures for applying the measure of sending to a compulsory drug detoxification establishment.

In which, there is a change in the amount of spending for drug addicts during the days they are on the road to be sent to compulsory detoxification establishments or centers or establishments that receive social objects from the date they are found. Specifically:

- Meal fee: 70,000 VND/person/day;
 
(Compared to the current in Circular 117/2017/TT-BTC, the meal rate is 40,000 VND/person/day)
 
- Room rental (if any) at the rate specified in Circular 40/2017/TT-BTC.
 
- Expenses for transportation or hiring of means of transport to bring back drug addicts: The level of expenditure shall comply with the provisions of Clause 3, Article 4 of Circular 62/2022/TT-BTC. (Newly added)
 
In addition, the regulations on the level of payment for the person assigned the task of tracking drug addicts who run away are as follows:

- Expenses for per diem: The content and level of expenditure are as prescribed in Circular 40/2017/TT-BTC.
 
- In addition to the per diem regime, when the fugitive is found and handed over to the receiving facility, the searcher is supported with 100,000 VND/person/day during the days of searching for the fugitive;
 
- Expenses for night work and overtime: Comply with current regulations of law on nighttime and overtime pay for cadres and civil servants;

Vietnam's Circular 62/2022/TT-BTC will go into effect on November 19, 2022, and will replace Vietnam's Joint Circular 121/2010/TTLT-BTC-BLDTBXH, Joint Circular 148/2014/TTLT-BTC-BLDTBXH, Circular 117/2017/TT-BTC, and Circular 124/2018/TT-BTC.
