Ministry of Labor, War Invalids and Social Affairs' request for improvement of the quality and efficiency of bidding activities in Vietnam under Directive 24/CT-TTg

The Minister of Labor, War Invalids and Social Affairs of Vietnam has issued Official Dispatch 4106/BLDTBXH-VKHTC dated September 04, 2024, regarding the implementation of Directive 24/CT-TTg dated July 29, 2024, of the Prime Minister of the Government of Vietnam on promoting and enhancing the effectiveness and efficiency of the execution of the Law on Bidding.

Improvement of the quality and efficiency of bidding activities in Vietnam under Directive 24/CT-TTg

The Minister of Labor, War Invalids and Social Affairs of Vietnam demands that project investors and heads of departments and units under and attached to the Ministry seriously study and implement the following directives to enhance the effectiveness and efficiency of implementing the Law on Bidding, with a particular focus on the following points:

(1) Fully implement solutions to improve the quality and effectiveness of bidding activities in accordance with the Prime Minister's Directive, ensuring openness, transparency, efficiency, cost-saving, and compliance with the law in Vietnam, preventing waste and loss of budget, funds, and public property.

(2) Assign units as public investment project investors:

- All bidding packages before being submitted to the Ministry for approval must be prepared, appraised, and approved by the investor in accordance with the provisions of point a, clause 2, Article 16 of Decree 24/2024/ND-CP.

- Strengthen the application of information technology in contractor selection, fully publish bidding information as required, and conduct online bidding for 100% of packages on the National E-bidding System, except for cases where online bidding is not permitted as specified in clause 9, Article 97 of Decree 24/2024/ND-CP.

(3) Assign heads of departments and units under and attached to the Ministry involved in bidding according to the bidding estimates:

- Seriously implement solutions as per Directive 24/CT-TTg and guidance in Official Dispatch 4106/BLDTBXH-VKHTC dated September 4, 2024.

- Proactively research and propose solutions to address difficulties, issues, rectify shortcomings, and organize contractor selection activities to ensure the availability of sufficient drugs, chemicals, testing materials, medical equipment, and other related services for medical examination, treatment, convalescence, and care of targeted objects.

- Manage closely the organization of bidding and bidding activities in compliance with the law; accelerate the implementation and quality of online bidding on the National E-bidding System as per the prescribed timeline.

(4) Assign the Department of Planning and Finance under the Ministry of Labor, War Invalids and Social Affairs of Vietnam to review and advise the Ministry on promulgating regulations regarding contractor selection in special cases under the Minister's jurisdiction, and regulations on the list of drugs applied to local centralized bidding.

(5) Assign the Ministry Inspectorate and heads of departments and units under and attached to the Ministry with subordinate units to strengthen the organization of regular inspections and monitoring of bidding activities, ensuring the requirements and quality, supervising the implementation of inspection and monitoring conclusions.
