Long-term Tree Planting for Protection of Hydraulic Works Must Have a Permit

The 2017 Law on Irrigation, passed by the XIV National Assembly at its 3rd session on June 19, 2017, prescribes activities for the protection of irrigation works as follows:

Within the scope of irrigation works protection, organizations and individuals performing the following activities must have a permit:

- Planting perennial trees;- Constructing new buildings;- Establishing docks, yards for gathering materials, fuels, supplies, vehicles;- Drilling, geological survey excavation; exploring and extracting minerals, building materials, groundwater;- Discharging wastewater into irrigation works (except for small-scale discharges that do not contain hazardous substances);- Engaging in tourism, sports, science, business, services;- Operating inland waterway vehicles, motor vehicles (except for motorcycles, mopeds, and primitive inland waterway vessels);- Aquaculture;- Blasting;- Constructing underground works.

The Ministry of Agriculture and Rural Development (MARD) and the provincial People's Committee (PPC) shall issue permits for the aforementioned activities.

The Law on Irrigation 2017 takes effect from July 1, 2018, replacing the Ordinance on Exploitation and Protection of Irrigation Works 2001.
