Key Points on Logistics Service Business Effective from February 20, 2018

On December 30, 2017, the Government of Vietnam issued Decree 163/2017/ND-CP on logistics service business.

Accordingly, foreign investors:

- If engaged in maritime freight services: Allowed to establish companies operating fleets or contribute capital, purchase shares, capital contributions, with a contribution rate not exceeding 49%;- If engaged in container handling in supporting transport services: Allowed to establish companies operating fleets or contribute capital, purchase shares, capital, with a contribution rate not exceeding 50%;- If engaged in inland waterway freight transport or rail transport services: Allowed to establish enterprises or contribute capital, purchase shares, capital contributions, with a contribution rate not exceeding 49%;- If falling under international treaties providing different conditions for logistics service business, investors may choose to apply the investment conditions specified in one of those treaties.

Decree 163/2017/ND-CP will take effect from February 20, 2018, replacing Decree 140/2007/ND-CP.
