Issuance of the Regulations on the Protection of state secrets by the Vietnam Trade Union organization in Vietnam

- Scope of Regulation:

The regulation on the protection of state secrets of the Vietnam Trade Union Organization (hereinafter referred to as state secrets) sets forth the provisions for identifying state secrets and their confidentiality levels; numbering and circulation; copying, duplication; statistics, storage, and preservation; transportation, delivery, and receipt; removal from storage locations; provision, transfer; organization of conferences, seminars, meetings containing state secret content; protection duration; extension of protection duration; adjustment of confidentiality levels; declassification; destruction of documents and materials containing state secrets; forms used in the work of protecting state secrets; responsibility for protecting state secrets; assignment of personnel to carry out state secret protection tasks; inspection; information policies, reporting; commendation and violation handling.

Matters not stipulated in this Regulation shall conform to the provisions of the Law on Protection of State Secrets and other guiding documents of Vietnam.

- Prohibited Acts in the Protection of State Secrets:

+ Disclosure, appropriation, purchase, sale of state secrets; falsifying, damaging, or losing documents and materials containing state secrets.

+ Illegal collection, exchange, provision, transfer of state secrets; illegal copying, duplication, storage, transportation, delivery, receipt, retrieval, destruction of documents and materials containing state secrets.

+ Illegally removing documents and materials containing state secrets from storage locations.

+ Exploiting, abusing the protection of state secrets, using state secrets to commit or conceal legal violations, infringe on legitimate rights and interests, or obstruct the activities of agencies, units, and individuals.

+ Drafting, storing documents containing state secrets on computers or other devices that are connected or currently connected to the Internet, computer networks, telecommunications networks, except for storing state secrets in compliance with laws on cryptographic protection.

+ Transmitting state secrets through information, telecommunication means in contravention of laws on cryptographic protection.

+ Changing the intended use of computers, other devices previously used to draft, store, exchange state secrets without eliminating state secrets.

+ Utilizing devices with signal transmission, reception, audio recording, and video recording capabilities in conferences, seminars, meetings containing state secret content in any form without the authorization of competent persons.

+ Posting, disseminating state secrets on mass media, the Internet, computer networks, and telecommunications networks.

More details can be found in Decision 1818/QD-TLD, which takes effect in Vietnam from October 01, 2024.
