Issuance of the Coordination Regulation between the Supreme People's Court and the Ministry of National Defense in the management of organizational structure of military courts in Vietnam

On November 15, 2024, the Standing Committee of the National Assembly of Vietnam passed Resolution 56/2024/UBTVQH15 on the Coordination Regulation between the Supreme People's Court and the Ministry of National Defense in the management of organizational structure of military courts in Vietnam.

The Coordination Regulation between the Supreme People's Court and the Ministry of National Defense in the management of organizational structure of military courts in Vietnam is issued with this Resolution.

For instance, the regulation on coordination in the organization of the apparatus, staffing, and personnel of military courts in Vietnam is as follows:

(1) The Chief Justice of the Supreme People's Court shall discuss and cooperate with the Minister of Defense before:

- Submitting to the National Assembly for approval the proposals for appointment, dismissal, or removal of the Supreme People's Court Judges who hold the position of Chief Judge of the Central Military Court as Deputy Chief Justice of the Supreme People's Court;

- Submitting to the National Assembly Standing Committee for decision on the representation of the Ministry of Defense leadership as a member of the National Judge Selection and Supervision Council;

- Submitting to the President for the appointment, dismissal, or removal of the Chief Judge of the Central Military Court as Deputy Chief Justice of the Supreme People's Court and the People's Court Judges of military courts;

- Deciding on the representation of the Ministry of Defense leadership as a member of the Judge Selection Examination Council of the Supreme People's Court.

(2) The Chief Justice of the Supreme People's Court shall agree with the Minister of Defense before:

- Submitting to the National Assembly Standing Committee for a decision on the establishment, dissolution of regional military courts and those with equivalent status, and regional military courts, as well as specifying the territorial jurisdiction of military courts;

- Submitting to the National Assembly Standing Committee for a decision on the number of People's Court Judges, the composition ratio of different levels of People's Court Judges at each level of military courts;

- Deciding on the establishment, reorganization, dissolution, and determining the functions and powers of the auxiliary machinery within military courts;

- Deciding on the appointment, dismissal, or removal of Deputy Chief Judge of the Central Military Court; Chief Judges and Deputy Chief Judges of regional military courts and those with equivalent status; Chief Judges and Deputy Chief Judges of regional military courts;

- Specifying the staffing and deciding on the allocation of staffing, number of People's Court Judges of military courts.
