Information subject to regular disclosure for businesses directly serving national defense and security in Vietnam

The regulations on Information subject to regular disclosure for businesses directly serving national defense and security and businesses engaged in economic cooperation with national defense and security under the Ministry of National Defense are as follows:

(1) For state-owned enterprises directly serving national defense and security, the following regulations apply:

- The content of reports and the disclosure of information are implemented according to Clause 1 of Article 14 of Decree 16/2023/NĐ-CP.

- The periodic report and disclosure of information are made according to Form 04/DC Appendix II attached to Circular 06/2024/TT-BQP.

(2) For businesses engaged in economic cooperation with national defense and security, the following regulations apply:

- State-owned businesses engaged in economic cooperation with national defense and security, where the state holds 100% of the charter capital, must disclose information periodically according to the content, form, and deadline specified in Article 23, Clause 1 of Decree 7/2021/ND-CP, as amended and supplemented in Article 13 of Decree 16/2023/NĐ-CP.

- Businesses engaged in economic cooperation with national defense and security, where the state holds over 50% of the charter capital, must disclose information periodically according to the content, form, and deadline specified in points a, c, d, e, and h of Clause 1 of Article 23 of Decree 47/2021/ND-CP.

- For important content or content related to state secrets in the field of national defense and security or business secrets, businesses engaged in economic cooperation with national defense and security must exclude them from the periodic report and compile a report on restricted information disclosure according to Form 05/DC Appendix II attached to Circular 06/2024/TT-BQP. This report must be submitted to the Ministry of National Defense (for businesses engaged in economic cooperation with national defense and security under the Ministry of National Defense) or the responsible unit under the Ministry of National Defense that is assigned to manage the business and sent to the Department of Economic Affairs and the Department of Military Security Protection before March 31 of the subsequent year.

Within 10 (ten) days from the date of receiving the report from the business engaged in economic cooperation with national defense and security (for businesses managed by the responsible unit under the Ministry of National Defense) or the document transfer slip from the Office of the Ministry of National Defense (for businesses engaged in economic cooperation with national defense and security under the Ministry of National Defense), the Department of Economic Affairs, in collaboration with the Department of Military Security Protection and relevant agencies and units, will appraise and report to the Minister of National Defense for consideration and decision on the restricted information disclosure, and notify the business to implement it and inform the Ministry of Planning and Investment for monitoring and supervision.
