Highlight of Notable Documents of the Week (from January 22, 2023, to January 27, 2023) in Vietnam

During the past week (from January 22, 2018, to January 27, 2018), Lawnet has updated several new documents in the fields of enterprise, finance, etc. in Vietnam

  1. Enterprise establishment fee in Vietnam is reduced to only 100,000 VND

Circular 130/2017/TT-BTC amends and supplements Circular 215/2016/TT-BTC on the rates of enterprise registration fees and information provision fees.

From January 20, 2018, the fees and charges for enterprise registration and provision of enterprise information are changed as follows:

- The fee for registering a business establishment, changing business registration content, and re-issuing the Enterprise Registration Certificate: From 200,000 VND reduced to 100,000 VND/time;

- The fee for issuing new certificates, re-issuing, or changing the content of the Certificate of Branch Operations, Representative Office, and Business Locations of enterprises: From 100,000 VND reduced to 50,000 VND/file;

- The fee for providing enterprise information (monthly subscription for 125 documents or more): From 5,000,000 VND reduced to 4,500,000 VND/month.

  1. Increase of 7.44% in allowances for certain People's Public Security officers and soldiers in Vietnam

According to the provisions of Circular 31/2017/TT-BCA, from July 01, 2017, the monthly allowance for certain People's Public Security officers and soldiers will be increased by 7.44% compared to the allowance level of June 2017.

For People's Public Security officers and soldiers who participated in the resistance war against the US with less than 20 years of service in the People's Public Security, who have resigned, retired to their localities, and those who participated in the war to protect the Fatherland, performed international duties in Cambodia, Laos after April 30, 1975, and have already demobilized, retired, or resigned:

- Belonging to the group entitled to monthly allowance policies specified in Article 4 of Joint Circular 05/2010/TTLT-BCA-BLDTBXH-BTC guiding the implementation of Decision 53/2010/QD-TTg;

- Belonging to the group entitled to monthly allowance policies specified in Clause 1, Article 3 of Joint Circular 05/2012/TTLT-BCA-BLDTBXH-BTC guiding the implementation of Decision 62/2011/QD-TTg.

Circular 31/2017/TT-BCA takes effect from November 01, 2017.

  1. Dossier for quality inspection of used imported automobiles in Vietnam

Circular 03/2018/TT-BGTVT prescribes regulations on quality inspection of technical safety and environmental protection for imported automobiles under Decree 116/2017/ND-CP.

The dossier for inspection of used imported automobiles includes the following documents:

- The registration form for quality inspection of technical safety and environmental protection of imported automobiles (according to Annex I);

- A copy of the valid Registration Certificate issued by a competent authority or organization abroad or equivalent legal documents;

- A copy of the commercial invoice;

- A copy of the manufacturer’s Vehicle Identification Number (VIN) decoding document;

- The original Import Vehicle Information Sheet (according to Annex III);

- A copy of the manufacturer’s vehicle feature and technical specification documentation;

- A copy of the import goods declaration form for paper dossiers; the number, date, month, and year of the declaration form for electronic dossiers.

  1. Establishment of hamlets and residential groups according to new conditions in Vietnam

The Ministry of Home Affairs of Vietnam issued Circular 09/2017/TT-BNV amending and supplementing Circular 04/2012/TT-BNV guiding the organization and activities of hamlets and residential groups.

Noteworthy is the condition on the number of households for establishing new hamlets and residential groups, which has doubled. To be specific::

Regarding the establishment of new hamlets:

- In the Northern, Central, and Central Highlands plains, there must be 400 households or more; in the Southern region, there must be 500 households or more (currently regulated from 200 households or more);

- In mountainous and island areas, there must be 200 households or more (currently regulated from 100 households);

Regarding the establishment of new residential groups:

- In the plains, there must be 500 households or more (currently regulated at least 250 households);

- In mountainous and island areas, there must be 300 households or more (currently regulated at least 150 households);
