During the past week (from July 30, 2018, to August 4, 2018), Thu Ky Luat has updated many new documents, notably documents in the fields of insurance, healthcare, education, etc., as follows:
Decision 772/QD-BHXH issued by Vietnam Social Security on June 15, 2018, announces a series of administrative procedures to replace the current ones regarding the collection of social insurance (SI), health insurance (HI), unemployment insurance (UI), occupational accident and disease insurance (OADI); management of SI books and HI cards.
To be specific:
- Procedures for registration, adjustment of compulsory SI, HI, UI, OADI; issuance of SI books, HI cards to replace the following four procedures:- Units participating for the first time, units moving from other provinces or cities;- Monthly adjustment of SI, HI, UI contributions;- SI, HI, UI arrears collection;- Employees with a fixed-term contract abroad self-registering for compulsory SI.- Procedures for registration, re-registration, adjustment of voluntary SI contributions; issuance of SI books replacing the procedures for registration, re-registration, adjustment of voluntary SI contributions;- Procedures for registration, issuance of HI cards for those who only participate in HI, replacing the procedures for participation in HI for those who only participate in HI.
For more details, refer to Decision 772/QD-BHXH, effective from the date of signing, which replaces Decision 1300/QD-BHXH dated November 6, 2015.
On July 20, 2018, the Ministry of Education and Training issued Circular 14/2018/TT-BGDDT regulating the standards for principals of secondary education institutions. This applies to principals of primary schools, lower secondary schools, upper secondary schools, multi-level schools, specialized schools, and boarding schools for ethnic minorities.
Notably, the standards for selecting key management officers for secondary education institutions include:
- At least 2 years of experience as a principal or vice-principal of a secondary education institution;- The principal or vice-principal of a secondary education institution is evaluated by the competent authority to meet at least the "good" level according to the principal standards;- Selected by the higher authority to meet the requirements for support and consultancy in organizing and implementing training activities for management personnel of secondary education institutions in the locality;- Aspiration to become a key management officer of a secondary education institution.
Circular 14/2018/TT-BGDDT is effective from September 4, 2018, replacing Circular 14/2011/TT-BGDDT and Circular 29/2009/TT-BGDDT.
According to Official Dispatch 2331/BHXH-DVT issued on June 25, 2018, by Vietnam Social Security, when reimbursing traditional medicine expenses at medical facilities, the following should be noted:
- The SI agency reimburses the cost of traditional medicine based on the purchase price of medicinal materials/traditional medicine according to regulations at the medical facility (the purchase invoice must clearly state the condition of the medicinal materials/traditional medicine when purchased), the loss rate of medicines during processing, and the loss rate in storage and packaging;- In the process of preparing medicinal materials/traditional medicine, if other expenses arise (such as electricity, water, fuel, packaging, other ingredients, etc.), the medical facility should provide detailed explanations, including the data constituting these expenses, and send Appendix 01, Circular 05/2015/TT-BYT to the SI agency for verification and reimbursement agreement.
Additionally, there are two new Official Dispatches regarding the implementation of conditional early release. Specifically:
4. Official Dispatch 3198/VKSTC-V8 issued on August 2, 2018, by the Supreme People's Procuracy regarding the resolution of issues in implementing conditional early release decisions.
Accordingly:
- The content “This decision may be appealed and is effective from the expiration of the appeal period…” in the form of a conditional early release decision issued by the court is compliant with the provisions of the Criminal Procedure Code and other relevant laws.- According to Clause 9, Article 368 of the Criminal Procedure Code, immediately after receiving the conditional early release decision, the detention facility must announce this decision and carry out the procedures for implementing conditional early release.
5. Official Dispatch 170/TANDTC-PC issued on August 1, 2018, by the Supreme People's Court requesting Chief Justices and unit heads to perform the following:
- Strictly comply with the provisions of the Criminal Code 2015, Resolution 01/2018, and the forms in Official Dispatch 160/TANDTC-PC dated July 23, 2018;- Specify the effective date of the conditional early release decision, which is 15 days from the date of signing and issuance, and the probation start date from when the decision becomes effective.
