Guidance on Procedures for Recognizing Mediation Outcomes at the Grassroots Level

On May 5, 2017, the Ministry of Justice issued Official Dispatch 1503/BTP-PBGDPL guiding the procedures for requesting the Court to recognize the results of grassroots mediation.

To have the conciliation results recognized at the grassroots level, the participating parties must meet the following conditions:

- Have full civil act capacity;- The case or matter under conciliation complies with the law on conciliation at the grassroots level;- The participating parties in the agreement are those who have rights and obligations relating to the content of the conciliation agreement. If the content of the successful conciliation agreement involves a third party, it must be approved by the third party;- Have a written successful conciliation document;- One or both parties have a request for the Court to recognize the conciliation results at the grassroots level.

The person submitting the request for the Court to issue a decision recognizing the conciliation results at the grassroots level must pay a provisional fee of 300,000 VND.

Requesting the Court to issue a decision recognizing the conciliation results at the grassroots level is not mandatory and completely voluntary.
