The Supreme People's Procuracy of Vietnam has issued Decision No. 201/QD-VKSTC promulgating the Regulation on the process of receiving, classifying, accepting, handling, and resolving petitions for reconsideration of court judgments and decisions that have taken legal effect under the procedures for cassation or retrial.
after receiving the citizens' petitions, the Supreme People's Procuracy (VKS) conducts an examination of the conditions for accepting the petitions. If the petitions fall under its jurisdiction, they will be handled as follows:
- For individuals, the petition must be signed or fingerprinted; for agencies or organizations, the legal representative must sign and affix the seal at the end of the petition;- Petitions requesting a cassation review or re-examination of civil cases or administrative judgments must be accompanied by the final judgment or decision, as well as any relevant evidence (if any);- Petitions requesting a cassation review or re-examination of criminal cases must contain the main contents stipulated in Article 374 and Article 399 of the Criminal Procedure Code;- If the petition does not meet the required conditions, guidance should be provided to the petitioner to supplement within a period of 1 month.
