Powers of the Ho Chi Minh City Interdisciplinary Cultural-Social Inspection Force

According to Article 5 of the Regulation on organization and operation of the Interdisciplinary Inspection Force in the fields of culture, information, and prevention and control of social evils in Ho Chi Minh City issued together with Decision 40/2021/QD-UBND (as amended by Decision 93/2024/QD-UBND), the powers of the Interdisciplinary Cultural - Social Inspection Force of Ho Chi Minh City are stipulated as follows:

(1) To request relevant competent authorities, organizations, and individuals in the locality to support and coordinate with the Interdisciplinary Cultural - Social Inspection Force in performing functions and duties throughout the inspection and handling of the case.

(2) To require those being inspected to comply with inspection decisions, present and provide all relevant documents according to the content of the inspection, and collaborate with the Interdisciplinary Cultural - Social Inspection Force during the inspection process.

(3) To draft Records of administrative violations; Meeting minutes; Records of temporary custody of evidence, administrative violation means, licenses, and practicing certificates; Decisions on temporary custody of evidence, administrative violation means, licenses, and practicing certificates; Decisions on personal search according to administrative procedures; Decisions on searching transport means, objects according to administrative procedures; Decisions on searching places where evidence, administrative violation means are concealed; Record of personal search according to administrative procedures; Record of searching transport means, objects according to administrative procedures; Record of searching places where evidence, administrative violation means are concealed (if any) in compliance with the Law on Handling Administrative Violations and the forms issued together with Decree 118/2021/ND-CP. In case the Government of Vietnam amends or supplements the forms, the new legal normative documents will apply.

(4) In case of detecting organizations or individuals with signs of criminal violations, promptly establish violation case files and transfer them to the competent criminal proceedings agency for handling according to the provisions of the law.

Principles of operation of the Interdisciplinary Cultural - Social Inspection Force of Ho Chi Minh City

According to Article 3 of the Regulation on organization and operation of the Interdisciplinary Inspection Force in the fields of culture, information, and prevention and control of social evils in Ho Chi Minh City issued together with Decision 40/2021/QD-UBND, the principles of operation of the Interdisciplinary Cultural - Social Inspection Force of Ho Chi Minh City are as follows:

- The forces participating in the interdisciplinary Cultural - Social inspection work must comply with the provisions of the law; ensure accuracy, objectivity, honesty, publicity, democracy, and promptness.

- The Interdisciplinary Cultural - Social Inspection Force has the duty to inspect the cultural - social activities of organizations and individuals in the city according to the content of each decision to establish the Interdisciplinary Cultural - Social Inspection Force.

- The Interdisciplinary Cultural - Social Inspection Force at all levels conducts inspections according to the plan and may conduct unexpected inspections (unannounced) for inspection subjects specified in Clause 2, Article 2 of this Regulation. During the inspection process, members of the Interdisciplinary Cultural - Social Inspection Force must perform the assigned tasks and powers correctly; not hinder the activities of the organizations and individuals being inspected; and be responsible before the law and the superior agency for their handling decisions.
