This is a noteworthy new point mentioned in Decree 163/2017/ND-CP regulating the business of logistics services.
Foreign investors are entitled to engage in logistics business through various forms such as capital contribution, purchase of shares, contributed capital, establishment of an enterprise, or business cooperation contract.
(Meanwhile, the current regulations only permit business through the establishment of a joint venture company).
Regarding the capital contribution ratio, foreign investors are allowed to contribute capital at the maximum rate as follows:
- Freight transport services within maritime transport services, inland waterway transport, and railway transport: Maximum not exceeding 49%;- Container handling services within support services for all modes of transport (excluding airports): Maximum not exceeding 50%;- Freight transport services within road transport services: Maximum not exceeding 51%.
