Formulation and issuance of documents for the implementation of the Law on the Organization of People's Courts in Vietnam

On July 31, 2024, the Supreme People's Court of Vietnam issued Directive 04/2024/CT-CA on the implementation of the Law on Organization of People's Courts 2024.

To ensure the necessary conditions for the prompt, comprehensive, consistent, and effective enforcement of the Law on the Organization of People's Courts 2024, the Chief Justice of the Supreme People's Court requests the heads of units under the Supreme People's Court, Chief Justices of the People's Courts, and Military Courts to focus on leading, directing, and implementing the formulation and issuance of documents for the enforcement of the Law on the Organization of People's Courts 2024 as follows:

- Organize the review of provisions of the Law on the Organization of People's Courts 2024 to propose to the Standing Committee of the National Assembly, the Judicial Council of the Supreme People’s Court, and the Chief Justice of the Supreme People's Court the issuance of legal normative documents as assigned by the Law in Vietnam.

- Organize the review of provisions of the Law on the Organization of People's Courts 2024 related to the functions, tasks, and powers of other agencies to propose to the competent state authority amendments, supplements, replacements, annulments, or issuance of legal normative documents to ensure compliance with the provisions of the Law on the Organization of People's Courts 2024.

- Urgently research and prepare the proposal dossier for the amendment of the Administrative Procedure Law, the Civil Procedure Code, and the Bankruptcy Law of Vietnam to ensure the specialized first-instance courts commence operations.

- The Department of Organization and Personnel, the Department of Legal and Scientific Management, the Department of General Affairs, the Inspection Committee, the Department of Planning and Finance, and the Central Military Court shall take the lead, in cooperation with relevant units, in promptly drafting legal normative documents as assigned in the Supreme People's Court’s Law Enforcement Implementation Plan, ensuring quality and timely completion.
