On July 15, 2022, the General Director of the General Department of Customs of Vietnam promulgated Decision No. 1399/QD-TCHQ 2022 on the Pilot Program for supporting and encouraging enterprises to voluntarily comply with customs laws.
According to Decision No. 1399/QD-TCHQ, participants of the Program on Voluntary Compliance with Customs Laws include:
- Customs enterprises that take charge of the management and organization of the Program.
- Enterprises engaged in import and export with headquarters registered for operation in Vietnam that are selected by customs agencies and voluntarily register for participation in the Program as members (hereinafter referred to as “member enterprises of the Program”)
- Associations of import-export enterprises participating as honorable members to support and provide advisory services for the Program.
The above-mentioned entities shall satisfy the following criteria:
- Enterprises shall fully perform the information update according to regulations prescribed in Circular No. 81/2019/TT-BTC and are verified and updated on the professional customs information system by customs agencies.
- Enterprises engaged in import and export for more than 365 days and received encouragement to improve their compliance from customs agencies after the assessment of such enterprises.
Enterprises and associations of enterprises that are invited in writing to participate in the Program by customs agencies and enterprises and associations of enterprises that voluntarily register for participation in the Program.
