Vietnam Social Security has just issued Decision No. 505/QD-BHXH amending and supplementing certain provisions of the Procedure for Collecting Social Insurance, Health Insurance, Unemployment Insurance, Occupational Accident and Disease Insurance; the management of Social Insurance books and Health Insurance cards promulgated together with Decision No. 595/QD-BHXH dated April 14, 2017.
The foreign employee working in Vietnam is subject to compulsory social insurance participation when having:
- A work permit, a practicing certificate, or a practicing license issued by the competent authority of Vietnam;- An indefinite-term labor contract or a definite-term labor contract with a duration of one year or more with the employer in Vietnam.
However, the case of employees moving within the enterprise as stipulated in Clause 1, Article 3 of Decree 11/2016/ND-CP and employees who have reached the retirement age as prescribed in Clause 1, Article 187 of the Labor Code are not subject to compulsory social insurance participation.
