Cases not required to carry out administrative procedures to notify sales promotion in Vietnam from December 1, 2024

According to point b, clause 3, Article 1 of Decree 128/2024/ND-CP amending clause 2, Article 17 of Decree 81/2018/ND-CP regarding cases not required to carry out administrative procedures to notify sales promotion in Vietnam:

- Conduct promotions in forms specified in clause 8, Article 92 of the Commercial Law and Articles 8, 9, 10, and 11 of Decree 81/2018/ND-CP, specifically including:

+ Organize for customers to participate in cultural, artistic, entertainment programs, and other events for promotional purposes;

+ Provide sample goods or sample services for customers to try free of charge;

+ Gift goods or provide services free of charge;

+ Sell goods or provide services at prices lower than previous selling prices or service supply prices, applicable during the notified promotion period (promotion by discount);

+ Sell goods or provide services accompanied by shopping vouchers or service vouchers.

- Conduct promotions with a total prize or gift value under 100 million VND in forms specified in Articles 12 and 14 of Decree 81/2018/ND-CP, including:

+ Sell goods or provide services accompanied by contest forms for customers to select winners based on announced terms and prizes (or other similar contest and awarding forms);

+ Organize frequent customer programs, where customer rewards are based on the quantity or value of goods or services purchased by the customer, presented in the form of customer cards, purchase acknowledgment slips, or other forms.

- Only conduct promotional programs in forms specified at Articles 12 and 14 of Decree 81/2018/ND-CP for goods or services sold or provided via e-commerce platforms, e-commerce platform applications, online promotion websites, and online promotion applications in Vietnam.

More details can be found in Decree 128/2024/ND-CP which comes into force in Vietnam from December 1, 2024.
