Cases Considered as Complicated Legal Aid Cases

Recently, the Ministry of Justice issued Circular 09/2018/TT-BTP stipulating the criteria for identifying complex and typical cases of legal aid (TGPL). Notably, there are new regulations on criteria for cases of non-litigation representation and legal consultation, alongside criteria for participation in criminal litigation, civil litigation, and administrative litigation.

cases of non-litigation representation, legal advice are determined as complex, typical legal aid cases when meeting one of the following conditions:

- Providing legal aid in cases of prolonged complaints that receive special public attention, covered by multiple central or local press agencies; or- Providing legal aid in cases where the legal aid organization petitions agencies or organizations on issues related to the case;- Providing legal aid in cases that have been resolved multiple times; or- Providing legal aid in cases handled by multiple competent agencies.
