Recently, the Ministry of Finance issued Circular 75/2020/TT-BTC amending and supplementing certain articles of Circular 279/2016/TT-BTC, which stipulates the rates, collection policies, management, and utilization of fees in food safety and hygiene activities.
In Circular 75, the Ministry of Finance has abolished the Fee Schedule in the Food Safety and Hygiene work issued together with Circular 279/2016/TT-BTC and promulgated a new fee schedule in the Food Safety and Hygiene work, while also stipulating the food safety and hygiene fee collection rates effective from August 12, 2020, as follows:
- From August 12, 2020, to the end of December 31, 2020, pay fees at 90% of the fee collection rates prescribed in the Fee Schedule in the Food Safety and Hygiene work issued together with Circular 75/2020/TT-BTC;- From January 1, 2021, onwards, pay fees according to the rates prescribed in the Fee Schedule in the Food Safety and Hygiene work issued together with Circular 75/2020/TT-BTC.
Additionally, Circular 75/2020/TT-BTC also stipulates that, from October 1, 2020, in the case where the fee-collecting organization is a public service unit or a government agency that is allocated operating expenses from the fee collection sources as prescribed in Clause 1, Article 4 of Decree 120/2016/ND-CP, 70% of the collected fee amount can be retained to cover the expenses as prescribed in Article 5 of Decree 120/2016/ND-CP. 30% of the collected fee amount must be submitted to the state budget according to the current State Budget Table of Contents. (According to Circular 279/2016/TT-BTC, 80% could be retained).
