The Government of Vietnam issued Decree No. 70/2021/NĐ-CP dated July 20 2021 amending Decree No. 181/2013/NĐ-CP on elaboration of some Articles of the Law on Advertising.
Decree No. 70/2021/NĐ-CP amends provision of cross-border advertising services in Vietnam as following:
When providing cross-border advertising services in Vietnam, Vietnamese and foreign advertising service providers, advertisement distributors and advertisers must comply with:
- Regulations of Vietnamese law on advertising
- Cybersecurity and management, provision and use of Internet services and online information
- Pay tax as per regulations of law on tax
Currently, regulations on activities on websites of foreign organizations and individuals trading in cross-border advertising services and generating advertising revenue in Vietnam must pay tax according to the provisions of tax law. .
Moreover, foreign organizations and individuals involved in provision of cross-border advertising services in Vietnam must notify the Ministry of Information and Communications 15 days before their cross-border advertising services are provided in Vietnam.
At the same time, do not create advertising products in content that violates the law specified in Clause 1 Article 8 of the Law on Cybersecurity and Article 28 of the Law on Intellectual Property.
Decree No. 70/2021/NĐ-CP takes effect from September 15, 2021.
