05 Significant Policies Effective from Mid-April 2019

1. Shortening the time frame for publicizing the conclusion of the content of a denunciation

This is a notable provision stipulated in Decree 22/2019/ND-CP on denunciation and the resolution of denunciations within the People's Public Security Forces.

Within a period of 07 working days (previously 10 days) from the date of concluding the content of the denunciation, and deciding on the handling of the law-violating behavior being denounced, the competent authority must publicize the conclusion of the content of the denunciation.

Simultaneously, based on the actual situation, the nature of the case, the requirements of the denunciation resolution, the competent authority may publicize the conclusion of the content of the denunciation by one or several methods prescribed in Clause 2, Article 40 of the Law on Denunciations 2018.

The publicization must ensure the confidentiality of the whistleblower's information and the contents belonging to state secrets.

2. Procedure for licensing the export of aquatic species

On March 8, 2019, the Government of Vietnam promulgated Decree 26/2019/ND-CP detailing several articles and measures for implementing the Law on Fisheries.

Organizations or individuals needing to export aquatic species listed in the inventory of species prohibited from export or conditionally exported but not meeting the conditions for scientific research or international cooperation should send the application dossier to the Directorate of Fisheries to request a license.

The application dossier for exporting aquatic species includes:

- Application form for the export license of aquatic species according to Form No. 36.NT;- Documents proving the export of aquatic species for scientific research purposes or international cooperation.

Within 10 working days, the Directorate of Fisheries considers the dossier content and submits it to the Ministry of Agriculture and Rural Development for consultation with the Prime Minister of the Government of Vietnam.

3. Common standards for competence and reputation of the Director of the Department of Information and Communications

Circular 01/2019/TT-BTTTT stipulates the standards for Director and Deputy Director positions of the Department of Information and Communications (DIC), issued by the Ministry of Information and Communications on March 5, 2019, detailing the standards for the competence and reputation of the Director of the DIC as follows:

- Have management, operational, and coordination competence; have innovative thinking; have vision;- Have a scientific working methodology, advisory, synthesis, analysis, and forecasting capability; ability to formulate policies, objectives, strategies, plans;- Have practical capability, firmly grasp the actual situation of the agency, unit, sector, and field in charge to concretize and effectively implement the Communist Party and State's policies;- Be responsible, dynamic, creative in work resolution, dare to think, dare to do, dare to take responsibility; have the ability to withstand high work pressure;- Have the ability to unite, leverage collective, individual strength;- Have the ability to apply and direct the implementation of IT application to improve and enhance work quality and efficiency;- Trusted and respected by superiors/subordinates, officials, and public employees within the unit.

4. Criteria to meet when prescribing daytime inpatient treatment at traditional medicine hospitals

The Ministry of Health has just issued Circular 01/2019/TT-BYT regarding the implementation of daytime inpatient treatment at traditional medicine examination and treatment facilities.

When prescribing daytime inpatient treatment, the following criteria must be met:

- The health and pathological status of the patient requires inpatient treatment but does not necessarily require 24/24 hour monitoring and treatment at the examination and treatment facility;- The monitoring and treatment time for daytime inpatient treatment for the patient is at least 4 hours/day at the examination and treatment facility;- If the patient's pathological condition can be treated outpatient, daytime inpatient treatment is not applied;- For patients not residing in the same province or city as the examination and treatment facility, the patient may receive daytime inpatient treatment or 24/24 hour inpatient treatment.

5. New points in the university admission priority policy in 2019

The Ministry of Education and Training has issued Circular 02/2019/TT-BGDDT amending the regulations on regular university admissions; regular college admissions for teacher training majors attached to Circular 05/2017/TT-BGDDT; amended by Circular 07/2018/TT-BGDDT.

The new regulation adds a case for determining the priority area for military personnel; officers, non-commissioned officers, conscripted soldiers within the People's Public Security Forces designated to take the exam.

To be specific: if stationed for 18 months or more in areas with different priority levels, the candidates will receive priority according to the area with the longer period of stationing.

In some other cases, the determination of the priority area is performed as follows:

- If stationed for 18 months or more in any area, the candidate receives priority according to that area or according to the permanent residence household registration before enlistment, depending on which area has a higher priority;- If less than 18 months, the candidate receives priority according to the permanent residence household registration before enlistment.
