Process of detection and inspection of inaccurate or non-operational electrical measuring devices in Vietnam from February 1, 2025

On February 01, 2025, the Minister of Industry and Trade of Vietnam issued Circular 13/2025/TT-BCT stipulating the determination of electricity payment in cases where measuring devices are inaccurate, cease operation, or are lost.

Under Clause 1, Article 2 of Circular 13/2025/TT-BTC, the process of detecting and inspecting inaccurate or non-operational electricity measuring devices is carried out as follows:

- When there is suspicion or detection that the electricity measuring device is operating inaccurately or has ceased operation, the electricity seller or buyer is responsible for notifying the other party and coordinating to draft a work record to document and address the situation. The electricity seller prepares the work record in paper form or as an electronic message equivalent to a written document according to legal regulations, for the electricity buyer to sign and confirm;

- In the event that the representative of the electricity buyer is absent, authorization must be made in accordance with relevant legal regulations; if the electricity buyer uses electricity for residential purposes, the legal representative of the electricity buyer, as defined by law, is authorized to sign the record. If the electricity buyer refuses to sign the record, the electricity seller must clearly state the reasons in the record and obtain the signature of a local government representative or local police agency;

- If the electricity measuring device must be dismantled for inspection, the electricity seller must notify the electricity buyer to witness the dismantling and verification of the device. The dismantled electricity measuring device must retain the seal of the inspecting organization. The electricity measuring device and any other related equipment must be retained, packaged, and sealed (the sealing paper must be signed by representatives of both the electricity buyer and the electricity seller);

- If the electricity buyer refuses to sign the seal according to the regulations in point c of this clause, the electricity seller must obtain the signature of a local government representative or a representative of the local police agency witnessing the electricity buyer's representative refusing to sign the sealing paper.
