Conditions and criteria for separating a land area into an independent project in Ben Tre are stipulated in Decision 08/2025/QD-UBND.

On February 5, 2025, the People's Committee of Ben Tre Province issued Decision 08/2025/QD-UBND stipulating the conditions, criteria, scale, and proportion of land area to be separated into independent projects within Ben Tre Province.

The conditions, criteria, scale, and proportion for separating land area into independent projects in Ben Tre are stipulated in Article 4 of Decision 08/2025/QD-UBND as follows:

- Conditions and criteria for the land area as per Article 1 of Decision 08/2025/QD-UBND to separate into an independent project:

+ Must comply with the land use planning of the districts and cities that have been approved and fit with other relevant plans (if any);

The land area separated into an independent project includes one or more contiguous lot(s) adjacent to each other, undivided by parcels, obtained by the project investor through land use transfer, lease, or capital contribution in the form of land use rights;

+ The land area separated into an independent project must be adjacent to existing transportation roads or planned roads approved by competent authorities with a minimum road width of 3 meters, a minimum width of 20 meters, and a minimum depth of 20 meters calculated from the edge of the road or the outer edge of the road safety corridor as per the plan (if any).

- For the land area that meets all the conditions and criteria in Clause 1, Article 4 Decision 08/2025/QD-UBND, it must meet the scale and proportion to separate into an independent project as follows:

+ For non-agricultural production and business projects; commercial and service projects; residential projects:

In  cases  where  the  project  has  a  scale  of  less  than  5,000m²,  the  proportion  of  the  land  area  to  be  separated  into  an  independent  project  is  20%  or  more.In  cases  where  the  project  has  a  scale  of  5,000m²  or  more,  the  land  area  to  be  separated  into  an  independent  project  must  be  at  least  1,000m².

+ For other projects not specified in Point a, Clause 2, Article 4 Decision 08/2025/QD-UBND:

the  project  has  a  scale  of  less  than  10,000m²,  the  proportion  of  the  land  area  to  be  separated  into  an  independent  project  is  30%  or  more  compared  to  the  total  area  proposed  for  project  implementation.If  the  project  has  a  scale  of  10,000m²  or  more,  the  land  area  to  be  separated  into  an  independent  project  must  be  at  least  3,000m².

+ In cases where the land area for a project is expanded, the determination of the land area to be separated into an independent project as stipulated in Points a and b, Clause 2, Article 4 Decision 08/2025/QD-UBND is calculated only on the expanded land area.

+ The land area stipulated at Points a and b, Clause 2, Article 4 Decision 08/2025/QD-UBND does not include areas within declared road safety corridors or hydraulic safety corridors, or according to the plan approved by competent authorities.

- If the land area does not meet the conditions, criteria, scale, and proportion to separate into an independent project as stipulated in Clauses 1 and 2, Article 4 Decision 08/2025/QD-UBND, then it shall proceed in accordance with Clause 2, Article 59 Decree 102/2024/ND-CP .
