Vietnam: Documents for occupational disease benefits for military servicemen

This is an important content specified in Circular No. 136/2020/TT-BQP providing guidance on dossiers, procedures, and responsibilities related to the settlement of social insurance benefits within the Ministry of Defense of Vietnam.

Article 14 of Circular 136/2020/TT-BQP stipulates the documents required for occupational disease benefits under Article 58 of the Law on Occupational Safety and Health for military personnel; cryptographic workers receiving salaries equivalent to military personnel; national defense officials, workers and public employees; contract workers in agencies, units, and enterprises under the Ministry of Defense, which include:

1. The Social Insurance Book.

2. The proposal letter to resolve occupational disease benefits from the head of the unit under the Ministry (Form No. 03H-HBQP).

3. The original discharge paper or summary of the medical record after treatment for occupational diseases; in cases without inpatient treatment at a medical facility, a medical examination record for the occupational disease is required.

4. The original assessment statement of the labor capacity decline rate from the Occupational Disease Medical Evaluation Council of the Ministry of Defense; the Occupational Disease Medical Evaluation Council of Military Hospital 175, Military Hospital 103. For laborers infected with HIV due to occupational risk accidents, a certificate of HIV infection due to occupational risk accidents following Form No. 02 Appendix II issued with Decision 120/2008/QĐ-TTg on August 29, 2008, from the Prime Minister about the conditions for identifying those exposed to HIV, infected with HIV due to occupational risk accidents is required.

5. A report on the results of labor environment monitoring following Form No. 04 Appendix III issued with Decree 44/2016/NĐ-CP on May 15, 2016, from the Government detailing certain provisions of the Law on Occupational Safety and Health regarding labor safety technical inspection activities, safety training, occupational hygiene, and labor environment monitoring, prepared by the competent authority; in cases where the labor environment monitoring report results are specified for multiple people, each laborer's file should include an excerpt of the labor environment monitoring report results. For laborers infected with HIV due to occupational risk accidents receiving occupational disease benefits, a workplace accident report following the regulations in Appendix I issued with Decision 120/2008/QĐ-TTg should replace this.

6. The decision on monthly or lump-sum occupational disease benefits (Form No. 03A-HBQP or Form No. 03B-HBQP).

7. The record of social insurance contributions (Form No. 04A-HBQP).

8. The backpay slip (Form No. 03N-HBQP), adjustment slip (Form No. 03P-HBQP) for monthly occupational disease benefits.

9. Notice of transfer to retirement benefits or social insurance benefits for those receiving monthly occupational disease benefits and being transferred to the local area (Form No. 10A-HBQP).

10. In cases of medical evaluation fee reimbursement, the documents as stipulated in Clause 10, Article 9 of this Circular are required.
