Vietnam: Applications for assessment of occupational accidents and occupational diseases for military servicemen

According to Article 12 of Circular 136/2020/TT-BQP, the dossier for requesting assessment of occupational accidents and diseases as regulated in Articles 5, 6, and 7 of Circular 56/2017/TT-BYT for military personnel; individuals working in cipher fields with salaries equivalent to military personnel; national defense officials, workers, and public employees; contract laborers in agencies, units, and enterprises under the Ministry of National Defense include:

1. A request form for occupational accident or disease assessment (first time, recurrent, or comprehensive assessment) by the employee (Form No. 14-HBQP).

2. A recommendation letter from the head of the unit subordinate to the Ministry in case the dossier is transferred to the Ministry of National Defense to introduce the employee for medical assessment.

3. An introduction letter from the authorized head of the unit or the Ministry of National Defense Social Insurance according to the form prescribed in Appendix No. 01 issued together with Circular 56/2017/TT-BYT.

4. In addition to the aforementioned documents, the dossier also includes:

  • In case of the first-time assessment request due to an occupational accident: Submit documents as guided in Clauses 3, 4, and 6 of Article 13 of this Circular, along with a copy of the social insurance book and the original or copy of the injury certificate issued by the medical facility (where the employee was treated) as per the prescribed form.

  • In case of the first-time assessment request due to occupational disease: Perform documents as guided in Clauses 3 and 5 of Article 14 of this Circular, along with a copy of the social insurance book; the original or copy of the occupational disease dossier, and a summary of the medical records of the treatment related to the occupational disease (if any).

  • In case of a request for reassessment due to recurrent occupational accident:

    • The original discharge paper or summary of the medical records of the recurrent injury treatment as per the prescribed form in Appendices 3 and 4 issued together with Circular 56/2017/TT-BYT;
    • A copy of the previous medical assessment minutes;
    • A copy of the dossier having received the occupational accident benefits;
    • For cases where the previous assessment did not meet the conditions on the level of working capacity reduction to receive additional occupational accident benefits, supplement the dossier as guided in Clause 4, Article 15 of this Circular.
  • In case of a request for reassessment due to recurrent occupational disease:

    • The original discharge paper or summary of the medical records as per the prescribed form in Appendices 3 and 4 issued together with Circular 56/2017/TT-BYT;
    • A copy of the previous medical assessment minutes;
    • The original or copy of the recurrent occupational disease dossier;
    • For cases where the previous assessment did not meet the conditions on the level of working capacity reduction to receive additional occupational disease benefits, supplement the dossier as guided in Clause 4, Article 15 of this Circular.
  • In case of a comprehensive assessment request:

    • The original or copy of the previous medical assessment minutes;
    • Other documents as guided in Points a, b, c, d, Clause 4, suitable to the subject and type of assessment.
