Vietnam: Female military servicemen shall submit dossiers for maternity benefits within 45 days

This is a notable content specified in Circular No. 136/2020/TT-BQP providing guidance on dossiers, procedures, and responsibilities related to the settlement of social insurance benefits within the Ministry of Defense of Vietnam.

Article 10 of Circular 136/2020/TT-BQP specifies the deadline for resolving maternity benefits for military personnel; cipher workers paid like military personnel; national defense officials, workers, and public employees; contract laborers within agencies, units, enterprises under the Ministry of National Defense, as per Article 102 of the Social Insurance Law, as follows:

  • Within 45 days from the date of returning to work, the female laborer or the worker is responsible for submitting the dossier as guided in Clauses 1, 2, 3, 4, 5, 6, 7, 10 of Article 9 of Circular 136/2020/TT-BQP to the personnel agency at the regimental level and equivalent. In case the worker has been discharged, demobilized, or resigned before giving birth, adopting a child, or receiving a child for custody, the dossier should be submitted as guided in Clause 9 of Article 9 of Circular 136/2020/TT-BQP to the social insurance agency where they reside for review and resolution under their jurisdiction.
  • Within 10 days from the receipt of a valid dossier, the employer must complete the resolution of the maternity benefits for the worker.
  • If the dossier is not resolved, the receiving agency must notify the worker in writing, stating the reason.

Furthermore, Article 7 of Circular 136/2020/TT-BQP also specifies the deadline for resolving sickness benefits as per Article 102 of the Social Insurance Law as follows:

  • Within 45 days from the date of returning to work, the worker is responsible for submitting the dossier as guided in Clause 1 or 2 of Article 6 of Circular 136/2020/TT-BQP to the personnel agency at the regimental level and equivalent.
  • Within 10 days from the receipt of a valid dossier, the employer must complete the resolution of the sickness benefits for the worker.
  • If the dossier is not resolved, the receiving agency must notify the worker in writing, stating the reason.
