Vietnam: Applications for allowance for recurrent occupational accident and desease for military servicemen

On October 29, 2020, the Ministry of Defense of Vietnam issued Circular No. 136/2020/TT-BQP providing guidance on dossiers, procedures, and responsibilities related to the settlement of social insurance benefits within the Ministry of Defense.

According to Article 15 of Circular 136/2020/TT-BQP, the applications for allowance for recurrent occupational accident and desease is regulated in Article 7 of Decree 88/2020/ND-CP, dated July 28, 2020, by the Government, detailing and guiding the implementation of certain articles of the Law on Occupational Safety and Health regarding compulsory occupational accident and disease insurance for military personnel; cryptographic workers receiving salaries similar to military personnel; national defense officials, workers, and public employees; and contract laborers in agencies, units, and businesses under the Ministry of National Defense, including:

1. The dossier for having received occupational accident and occupational disease allowances managed by the personnel agency (for cases that have already received allowances); Social Insurance Book (for cases that have undergone an assessment but do not meet the conditions for a labor ability decrease to receive allowances).

2. A document requesting the resolution of occupational accident and occupational disease benefits from the head of a subordinate unit of the Ministry (Form 03H-HBQP).

3. The original discharge certificate after treatment and stabilization of the old injury or disease recurrence.

4. The accident investigation record; in case of a traffic accident identified for occupational accident benefits, one of the following documents is additionally required: accident scene examination record, site diagram of the traffic accident, or traffic accident record from the police or military criminal investigation authority for cases in which previous examinations did not meet the conditions of reduced labor ability to receive occupational accident benefits, or Measurement results, Environmental labor monitoring report for cases in which previous examinations did not meet the reduced labor ability conditions to receive occupational disease benefits.

5. The labor ability reduction assessment record from the last competent Military Medical Assessment Council for cases that have undergone an assessment but do not meet the conditions for reduced labor ability to receive allowances.

6. The original re-assessment record of labor ability reduction after treatment due to recurrent old injury or disease from the competent Military Medical Assessment Council.

7. Decision on monthly or one-time occupational accident or occupational disease benefits due to recurrent injury or disease (Form 03C-HBQP or Form 03D-HBQP).

8. Social Insurance contribution history record (Form 04A-HBQP).

9. Notification of transfer of retirement pension entitlement, social insurance benefit for cases receiving monthly occupational accident and occupational disease benefits due to recurrent wounds or diseases while also transferring to the locality (Form 10A-HBQP).

10. For reimbursement of medical assessment fees, the dossier follows the regulations in clause 10 of Article 9 of this Circular.
