The translator must present a transcript or documents proving language proficiency

This is a newly added regulation in Circular 01/2020/TT-BTP, which provides detailed regulations and guidance on the implementation of certain provisions of Decree 23/2015/ND-CP regarding the issuance of copies from master registers, certification of copies from originals, certification of signatures, and certification of contracts and transactions.

This Circular supplements conditions for translators of foreign languages who do not hold a bachelor's degree (university) in the foreign language to be translated.

To be specific, Clause 1 Article 16 of Circular 01/2020/TT-BTP stipulates as follows:

In the case of holding a university degree or higher in another specialization taught in the foreign language to be translated, the translator must additionally present transcripts or documents proving their proficiency in the language.

Currently, according to the provisions of Clause 2 Article 27 of Decree 23/2015/ND-CP which is guided by Article 9 and Article 10 of Circular 20/2015/TT-BTP, the translator must have a bachelor's degree or higher in the foreign language to be translated or have a university degree or higher in another specialization taught in the foreign language to be translated. This means that current regulations stipulate the standards for translators without requiring them to present transcripts or documents proving their proficiency, but only require a university degree or higher taught in the language to be translated.

Thus, from April 20, 2020, individuals who do not hold a bachelor's degree (university) in the foreign language to be translated will need to additionally submit transcripts or documents proving their proficiency in their file composition.

It can be seen that with this new regulation, the Ministry of Justice aims to tighten the standards for translators of foreign languages at organizations offering translation services. This ensures the quality of translation services, minimizing errors that may affect individuals and organizations using these services.
