This is a new proposal in the Draft Law on Amendments and Supplements to several articles of the Law on Construction, the Law on Housing, the Law on Real Estate Business, and the Law on Urban Planning which is currently being solicited for feedback by the Ministry of Construction.
According to Clause 2, Article 89 of the 2014 Construction Law, there are 10 types of projects exempted from construction permits, such as: state secret works, temporary construction works serving the construction of main projects, and urban housing projects under 7 floors with a total floor area of less than 500 m^2^.
However, in the Draft Amended Law, the Ministry of Construction proposes to add some types of projects that will be exempted from construction permits, including:
- Outdoor advertising screens with an area of one side less than 20 m^2^; signage and advertising boards with an area of one side less than 20 m^2^, with a metal frame structure or similar building materials attached to existing construction works; standalone advertising boards with an area of one side less than 40 m^2^;- Works that have been appraised by specialized construction agencies and are part of investment projects approved by competent state agencies, or part of urban development projects, and housing development projects;
Concurrently, some projects that are not exempt from construction permits will be abolished, such as:
- Projects that are part of investment construction projects decided by the Prime Minister, Ministers, Heads of ministerial-level agencies, and Chairman of People's Committees at various levels;- Housing projects within urban development projects and housing development projects under 7 floors and with a total floor area of less than 500 m^2^, with a detailed 1/500 planning approved by competent state agencies;- Rural technical infrastructure works that only require an Investment Construction Project Brief and are located in areas without approved detailed rural residential planning;
