04 Most Prominent Regulations Effective in February 2018

In February 2018, many new regulations began to take effect, among which the following four regulations are the most notable:

Support of VND 450,000/month for preschool teachers and lunch money for children

Decree 06/2018/ND-CP with policies aiming to support teachers and children in preschool education comes into effect on February 20, 2018, featuring notable provisions such as:

- Teachers (including vice principals) working under a labor contract complying with the quota in public preschool establishments who meet the class IV standards or higher, will be signed into labor contracts, appointed on the salary scale according to Decree 204/2004/ND-CP, and enjoy policies similar to public employees;- Teachers working in non-public, private preschool institutions will be supported with materials and training costs when participating in professional advancement courses;- Teachers directly taking care of and educating minority children in specially difficult areas will be reimbursed for purchasing study materials (excluding reference materials) in the minority language and writing, paid according to financial invoices and reimbursed for 3 years;- Support of VND 450,000/month for 9 months/year (from September of the previous year until the end of May of the following year) for the following subjects:

- Teachers teaching 2 sessions/day at toddler groups, mixed-age classes at remote points;- Teachers enhancing Vietnamese language at preschool groups or classes with minority children at remote, difficult public points.

- Lunch support amounting to 10% of the statutory pay rate/child/month for preschool children eligible for support policies.

Abolition of the regulation "buying and selling vehicles must be notified to the police authorities"

This notable content is referenced in Circular 64/2017/TT-BCA regarding amendments to Circular 15/2014/TT-BCA on vehicle registration.

Circular 64/2017 abolished the regulation: "Before selling, donating, or gifting the vehicle, the owner must notify in writing to the authority that issued the vehicle registration certificate."

Meanwhile, the content remains unchanged: "Within 30 days from the date of making the documents for transferring vehicle ownership, the organization or individual purchasing, receiving the transfer, or being gifted the vehicle must go to the vehicle registration authority to complete the procedures for transferring the vehicle's name."

Therefore, to allow the police authorities to monitor the ownership status of the vehicles and have the basis to determine responsibility when accidents occur; the vehicle owner does not need to notify the police about the sale or donation of the vehicle. The buyer or the recipient only needs to complete the procedure for transferring the vehicle's name.

Circular 64/2017/TT-BCA takes effect from February 12, 2018.

Check labor export information on the internet from February 12, 2018

This prominent information is mentioned in Circular 35/2017/TT-BLDTBXH regulating the management, operation, and exploitation of the database on Vietnamese workers going abroad to work.

Units and enterprises related to labor export will update information on labor export at the website csdl.dolab.gov.vn. The information to be updated includes:

- Personal information of workers;- Information about the training process, working abroad, contract termination of workers;- Information about labor-exporting enterprises.

At the same time, procedures such as issuing, renewing, and re-issuing labor export service operation licenses can also be performed at the aforementioned website.

New regulations on logistic service business conditions for foreign investors

On December 30, 2017, the Government of Vietnam issued Decree 163/2017/ND-CP, allowing foreign investors to contribute capital to logistics service businesses; concurrently, detailing conditions for foreign investors in the following cases:

- Freight transportation services in maritime transport (excluding domestic transport);- Container handling services under maritime transport support services;- Container handling services under all modes of transport support services, except services provided at airports;- Customs clearance services under maritime transport support services;- Other services, including the following activities: Bill of lading inspection, freight forwarding brokerage services, cargo inspection services, sampling and weight determination services, receipt and acceptance services, preparation of transportation documents;- Freight transport services in inland water, railway transport services;- Road freight transport services;- Air freight transport services;- Technical analysis and testing services.
