1. What is voluntary team?

According to Clause 1, Article 2 of Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC, voluntary team means a voluntary organization including persons participating in prevention and combat from social vices in communes, wards and townships;

Which is establishes, organized and operated as prescribed in Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC and relevant other legal documents. 

According to Article 1 of Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC, Volunteer Team is the abbreviation of voluntary social work teams in communes, wards and townships.

2. Procedures for establishment of Voluntary teams in Vietnam

Procedures for establishment of Voluntary teams according to Article 7 of Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC are as follows:

- Based on practical situation, requirements of prevention and combat from social vices in communes, wards and townships, People’s Committees of communes, wards and townships (hereinafter abbreviated to communal People’s Committee) shall make dossier requesting for establishment of Voluntary teams as prescribed in clause 3 of Article 7 of Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC and directly send or by post office to the district-level Division of Labor, War Invalids and Social Affairs.

- Within 10 (ten) working days after receiving, to the district-level Division of Labor, War Invalids and Social Affairs shall consider dossiers and submit them to the Chairperson of the district-level People’s Committee for issuance of decisions on establishment of voluntary teams. In case refusal for establishment, the district-level Division of Labor, War Invalids and Social Affairs must have a written reply clearly stating reason thereof and send it to the Chairperson of the district-level People’s Committee. 

- Dossier (01 set) requesting for establishment of Voluntary teams includes:

+ Report on requesting for establishment of Voluntary team of the Chairperson of communal-level People’s Committee, of which content clearly state the necessity of establishment of voluntary team, quantity and structure of members of voluntary team.

+ Draft of Regulation on operation of Voluntary team.

3. Procedures for dissolution of Voluntary teams in Vietnam

Procedures for dissolution of Voluntary teams according to Article 8 of Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC are as follows:

- A voluntary team is dissolved in the following cases:

+ At the request of the Chairperson of communal-level People’s Committee;

+ There is serious violation in management, organization and operation of the Voluntary team. There are 2/3 (two-thirds) of members of voluntary team violating law and being administratively sanctioned, examined for penal liability or activities of team are inconsistent with functions, tasks specified in Article 10 of this Joint Circular.

- Within 05 (five) working days, after receiving report on detecting violation of member of voluntary team, chief of the division of Labor, War Invalids and Social Affairs shall consider the proposal on dissolution of the chairperson of the communal People’s Committee as prescribed in point a clause 1 of Article 8 of Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC,

Or inspect, assess extent of violation as prescribed in point b clause a of Article 8 of Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC and make a written report (01 set) to submit the Chairperson of the district-level People’s Committee.

- Within 05 (five) working days, after receiving written report of chief of the division of Labor, War Invalids and Social Affairs, the chairperson of the district-level People’s Committee shall issue Decision on dissolution of Voluntary team.

4. Competence for establishment, dissolution of Voluntary teams in Vietnam

Competence for establishment, dissolution of Voluntary teams according to Article 6 of Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC is as follows:

The Chairpersons of the People’s Committee of districts, towns, provincial cities (hereinafter abbreviated to provincial People’s Committee) shall decide establishment, dissolution of Voluntary team.

5. Functions and tasks of Voluntary teams in Vietnam

The functions and duties of the Volunteer Team according to Article 10 of Joint Circular 24/2012/TTLT-BLDTBXH-BNV-BTC are as follows:

- Voluntary teams support communal People’s Committees in prevention and combat of social vices in their localities, and operate under Regulation approved by the Chairpersons of district People’s Committee.  

- Specific tasks of Voluntary teams:

+ Organizing activities to inform, propagate, educate for the prevention of drug abuse, prostitution vices, reduction of HIV/AIDS infection and harm, support for victims trafficked in communities;    

+ Participating in management, advisory, education, convert, mobilization and support for drug addicts in order to perform the detoxification, prostitutes in order to reform their life, victims of human trafficking in order to integrate into the community;

+ Detecting violations of law on prevention and combat of drug abuse, prostitution, HIV/AIDS and human trafficking vices in order to report to functional agencies for handling and having measures to prevent and stop violations;

+ Participating in implementation of socio-economic programs in localities such as hunger elimination, poverty reduction, vocational teaching, creating jobs, gender equality, reduction of stigma and discrimination, accessing to health and social services, helping drug addicts after detoxification, prostitutes to be reformed, victims trafficked to come back and stabilize life, integrate into community;   

+ Participating in integration of social vice prevention and combat with the campaign “The entire people unify to build cultural life in residential areas”, building health communes, wards and townships without social vices and other movements in localities.
