Recently, the Ministry of Public Security issued Circular 58/2020/TT-BCA stipulating the procedures for issuing and revoking registration and license plates for road motor vehicles, replacing Circular 15/2014/TT-BCA, and officially taking effect from August 1, 2020.

According to Clause 3, Article 6 of Circular 58/2020/TT-BCA, it is stipulated: Within 7 days from the date of making the documents for transfer of vehicle ownership to another organization or individual in a different province or centrally-run city, the vehicle owner must directly or authorize an individual or service organization to submit the Vehicle Registration Certificate and license plate to the vehicle registration authority.
For the title transfer to an organization or individual within the same province or centrally-run city, the vehicle owner must directly or authorize an individual or service organization to submit the Vehicle Registration Certificate to the vehicle registration authority. In cases where the organization or individual purchasing, being transferred, given, allocated, or inherited the vehicle handles the title transfer procedures immediately, the procedure for revoking the Vehicle Registration Certificate is not required.
In addition, Circular 58 also provides regulations on title transfer for vehicles that have changed ownership through multiple people. Specifically:
1. Procedures and documents for title transfer
The current vehicle user must go to the vehicle registration dossier management authority to carry out the title transfer procedures, present the documents as specified in Article 9 of this Circular, clearly state the process of legal vehicle purchase and handover, commit to the origin of the vehicle, and submit the following documents:
- Vehicle Registration Certificate and license plate as prescribed in Clause 3, Article 6 of this Circular;- Documents for vehicle ownership transfer from the person named in the Vehicle Registration Certificate and the vehicle ownership transfer documents from the last seller (if any);
2. Procedures and documents for registration of title transfer
The current vehicle user must contact the vehicle registration authority at their place of residence, present the documents as specified in Article 9 of this Circular, and submit the following documents:
- Vehicle registration declaration form (according to Form No. 01 issued with this Circular);- Proof of payment of registration fee as per regulations;- Certificate of revocation of registration, license plate (for cases involving different provinces and motorcycles with different registration points)
The vehicle registration authority has the following responsibilities:
For cases where the current vehicle user has the documents for vehicle ownership transfer from the person named in the Vehicle Registration Certificate and the documents for vehicle ownership transfer from the last seller: Within 2 working days from the date of receiving a complete and valid dossier, the vehicle dossier management authority must process the registration, issue a license plate (for cars transferring within the same province and motorcycles at the same registration point) or issue a Certificate of Revocation of Registration and a license plate for the current vehicle user to carry out the registration and issuance procedures at the place of residence;
For cases where the current vehicle user does not have the documents for vehicle ownership transfer, the vehicle dossier management authority must:
- Issue a receipt valid for vehicle use within 30 days;- Notify the person named in the vehicle registration, publicly post on the website of the Traffic Police Department and at the authority's office;- Search the lost vehicle database and the vehicle registration data immediately after receiving the transfer dossier.- After 30 days, if no disputes or complaints arise, the vehicle dossier management authority must process the registration, issue a license plate (for cars transferring within the same province and motorcycles at the same registration point) or issue a Certificate of Revocation of Registration and a license plate for the current vehicle user to carry out the registration and issuance procedures at the place of residence.
Note: The current vehicle user must present themselves at the vehicle registration authority to carry out the title transfer procedures; declare and commit to being legally responsible for the origin of the vehicle, the process of purchase and handover; declare and pay the registration fee as per legal regulations.
