From September 1, 2020, No More Fines for Late Birth Registration for Children

The upcoming regulation stipulating the warning penalty for individuals responsible for registering the birth of a child past the deadline will be abolished.

Specifically, at Clause 1 Article 27 Decree 110/2013/ND-CP stipulates:

Article 27. Acts of violation of birth registration regulations

1. Warning to those responsible for registering the birth of a child but failing to register within the prescribed time limit.

In which, the time limit for registering the birth of a child is 60 days from the date of birth (Article 15 Civil Status Law 2014).

However, from September 1, 2020, when Decree 82/2020/ND-CP comes into effect, the regulation of warning for the act of registering the birth of a child late will be abolished. Instead, the penalties for the following acts will be increased:

- A fine of VND 1,000,000 to VND 3,000,000, and confiscation of exhibits for acts of erasing, altering, and falsifying the contents of documents issued by competent authorities, organizations, or persons for the purpose of birth registration. (The current fine is from VND 300,000 to VND 500,000)

- A fine of VND 3,000,000 to VND 5,000,000 for any of the following acts:

+ False declaration, false testimony about birth;

+ Providing false information or documents about birth registration content;

+ Using another person’s documents for birth registration procedures.

In addition, the competent authorities and organizations will review and handle birth certificates issued in violation of the above regulations, and documents or records that have been tampered with or falsified.

The abolishment of the regulation on warning for the act of late birth registration under Decree 82/2020/ND-CP is suitable for practical situations. Currently, most people who register late for their child’s birth have difficult circumstances and have not accessed legal regulations, making it difficult to avoid violations.

However, people should also promptly register the birth of their child so that the child can enjoy rights such as obtaining health insurance cards and attending school at the appropriate age.
