Circular 75/2024/TT-BCA has stipulated the entities permitted to be equipped with military weapons, explosives, and supporting tools within the police force in Vietnam from January 1, 2025.

On November 15, 2024, the Minister of Public Security issued Circular 75/2024/TT-BCA guiding the Law on Management and Use of Weapons, Explosives, and Support Tools.

Subjects equipped with military weapons, explosive materials, support tools of the Public Security Forces in Vietnam from January 1, 2025

Article 9 of Circular 75/2024/TT-BCA stipulates the subjects equipped with military weapons, explosives, and support tools of the Public Security Forces in Vietnam as follows:

- Subjects equipped with military weapons and support tools include:

+ Departments and Commands under the Ministry of Public Security; People's Police academies and schools;

+ Provincial-level Police;

+ Prisons, detention centers; compulsory education establishments, reformatories; Training and Professional Development Centers for People's Police;

+ District-level Police, including district, district-level town, cities under provinces, and cities under central-affiliated cities (abbreviated as District-level Police);

+ Commune-level Police.

- Subjects equipped with sports weapons include:

+ People's Police academies and schools;

+ Training and Sports Competition Centers for People's Police;

+ Training and Professional Development Centers for People's Police with sports competition training.

- Subjects equipped with military explosives include:

+ Departments and Commands under the Ministry of Public Security; People's Police academies and schools;

+ Provincial-level Police;

+ Prisons, detention centers; compulsory education establishments, reformatories; Training and Professional Development Centers for People's Police;

+ District-level Police, including district, district-level town, cities under provinces, and cities under central-affiliated cities (abbreviated as District-level Police).

Authority for equipping weapons, explosives, support tools for Public Security Forces in Vietnam

Specifically, Article 11 of Circular 75/2024/TT-BCA stipulates the authority for equipping weapons, explosives, and support tools for Public Security Forces in Vietnam as follows:

- The Minister of Public Security decides to equip the entire People's Police force with weapons, explosives, and support tools.

- The Director of the Department of Equipment and Logistics decides to supplement weapons, explosives, and support tools for the police units and localities after obtaining the Minister's approval.

- Based on the quantity, type of weapons, explosives, and support tools equipped, heads of units, Provincial Police Directors decide to equip the quantity, type of weapons, explosives, and support tools for the units under their management.

- In cases where Provincial-level Police need to equip support tools using local funds, the Provincial Police Director decides to equip and implement according to the provisions of Article 53 of the Law on Management and Use of Weapons, Explosives, and Support Tools; after equipping, report to the Department of Equipment and Logistics for monitoring, management, and to add to the assets of the People's Police.

Authority for transfer of weapons, explosives, support tools for Public Security Forces in Vietnam

According to Clause 1, Article 12 of Circular 75/2024/TT-BCA, the authority for the transfer of weapons, explosives, support tools is as follows:

- The Minister of Public Security decides to transfer weapons, explosives, and support tools from one police unit, locality to another across the country in case of emergency situations, threats to national security but not to the extent of declaring a state of emergency;

- In cases not covered by point a of this clause, the Director of the Department of Equipment and Logistics decides to transfer weapons, explosives, and support tools from one police unit, locality to another after reporting and obtaining approval from the Minister of Public Security;

- Heads of police units, localities decide to transfer weapons, explosives, and support tools between units under their management.
