According to Clause 3, Article 1 of the Law on Promulgation of Legal Documents amended in 2020, a legal document can be promulgated to simultaneously amend, supplement, replace, or annul the contents of multiple legal documents promulgated by the same agency in the following cases:
- To implement relevant international treaties to which the Socialist Republic of Vietnam is a member;
- The contents to be amended, supplemented, replaced, or annulled are closely related to ensure synchronization and consistency with the newly promulgated document;
- To implement the approved plan for simplifying administrative procedures.
Additionally, this Clause also stipulates:
When promulgating a legal document, the promulgating agency must simultaneously amend, supplement, annul the document, section, chapter, part, subpart, article, clause, point of the legal document that it has issued contrary to the new document's provisions;
However, in cases where the document, section, chapter, part, subpart, article, clause, point of the legal document it has issued includes provisions different from the new document but needs to continue to be applied, this must be specified in the new document.
This regulation can be understood as when the promulgating agency issues a document with content differing from the new document but matches the practical application of the law, it can still be applied but must be specified in the new document.
