The Government of Vietnam has just issued Decree No. 77/2021/NĐ-CP dated August 1, 2021 on seniority allowance for teachers. The Decree clearly stipulates the time for calculating the benefit, the time for excluding the seniority allowance, the allowance level, and the way to calculate the seniority allowance.

According to the Decree No. 77/2021/NĐ-CP issued by the Government of Vietnam, teachers who are teaching and educating in public educational institutions and academies, schools and training centers under state agencies, political organizations, and socio-political organizations Associations (hereinafter collectively referred to as public educational institutions) that have been transferred and ranked according to the Decree No. 204/2004/ND-CP will continue to receive the seniority allowance for teachers. The period for calculating the seniority allowance for teachers under the new regulations includes:
(1) The period of teaching and educating with compulsory social insurance payment in public educational institutions.
(2) The period of teaching and educating with compulsory social insurance payment in non-public educational institutions (for teachers who are teaching and educating in public educational institutions who previously taught and educated in non-public educational institutions).
(3) Working time for which the seniority allowance is calculated, including: the working time is paid according to one of the ranks or titles specialized in customs, courts, procurators, audits and inspectors, civil judgment enforcement, ranger, national reserve, Communist Party inspection; working time calculated for seniority allowance in the army, police, cipher and working time calculated for seniority in other professions (if any).
(4) The period of military service according to the law of Vietnam and calculated for seniority allowance before the military service.
The condition to benefit from the seniority allowance is that the teacher has participated in teaching and educating with compulsory social insurance payment for 5 years (60 months). If these conditions are met, the teacher will be entitled to a seniority allowance equal to 5% of the current salary plus the allowance for the leadership position and the extra-seniority allowance (if any). From the sixth year onwards, each year (full 12 months) is charged 1% more.
The seniority allowance is calculated and paid in the same monthly salary period and is used to calculate the payment and enjoyment of social insurance, health insurance and unemployment insurance.
The monthly seniority allowance is calculated according to the following formula:
Provinces and cities, public educational institutions which have been implemented seniority allowance payment for teachers from July 1 2020 up to now, continue the implementation according to this Decree.
Teachers who are teaching in public educational institutions who still hold the rank officials in the education and training sector (with the first 2 digits of the rank code being 15) but have not yet been classified into the professional title of specialized public employee in education and training majors (code V07) and vocational education majors (code V09) are still entitled to the teacher seniority allowance according to the provisions of this Decree.
With this new regulation and the change of teacher's salary from March 20, 2021 according to the series of 4 circulars of the Ministry of Education and Training of Vietnam on appointment and salary ranking of teachers at all levels, teachers' salaries will increase, especially for pre-school, primary and secondary schools.
