Additional regulations related to the conditions for the business of car driving training services and driver testing services have just been amended and supplemented.

The Government of Vietnam has issued Decree 138/2018/ND-CP, amending and supplementing certain articles of Decree 65/2016/ND-CP dated July 1, 2016, of the Government of Vietnam, which stipulates the business conditions for automobile driving training services and driving examination services.
To be specific, concerning the conditions of technical facilities, Decree 138/2018/ND-CP amends the conditions of the Technical Driving classroom as follows: Equipped with audiovisual teaching aids (tapes, projectors...); has pictures or drawings depicting basic driving maneuvers (adjusting the driver's seat, driving posture, steering wheel position...); has automobiles safely lifted for practicing manual transmission and automatic transmission (can be arranged separately); has a simulator for driver training.
The theoretical teacher must have a diploma of intermediate level or higher in one of the following fields: law, automotive technology, automotive engineering technology, automobile assembly, or other professions with an automobile training content of 30% or more.
Regarding the condition of practice vehicles, an automobile driving training institution must have practice vehicles of various types licensed by the competent authority; in cases where the training institution provides driving examination services, based on the time used for examination purposes, it is allowed to use examination vehicles for both examining and training drivers, but the number of examination vehicles used to calculate the training volume must not exceed 50% of the total examination vehicles used for driving instruction. The driving practice yard must be legally used by the driving training institution.
In addition to technical facilities, Decree 138/2018/ND-CP also amends the conditions regarding teachers. A driving training institution must have a team of theoretical and practical teachers meeting the stipulated standards; ensuring at least one practical driving teacher per training vehicle.
The driving teacher must meet the standards for teaching at the elementary level according to the regulations on vocational education.
The theoretical teacher must have a diploma of intermediate level or higher in one of the following fields: law, automotive technology, automotive engineering technology, automobile assembly, or other professions with an automobile training content of 30% or more, and the Technical Driving instructor must have a corresponding or higher driving license for the type of vehicle being trained.
Meanwhile, the practical driving teacher must meet the following standards:
Firstly, must have a corresponding or higher driving license for the type of vehicle being trained, but not lower than class B2.
Secondly, a teacher for classes B1, B2 must have held a valid driving license for at least 3 years since passing the driving examination.
Thirdly, a teacher for classes C, D, E, and F must have held a valid driving license for at least 5 years since passing the driving examination.
Fourthly, must have undergone training in practical driving instructional skills according to the program issued by the competent authority and possess a Certificate of Practical Driving Instruction as per the prescribed form.
Regarding the competent authority to issue certificates for practical driving instructors, Decree 138/2018/ND-CP stipulates that the Directorate for Roads of Vietnam issues certificates for practical driving instructors in training institutions under central agencies assigned by the Ministry of Transport; the Department of Transport issues certificates for practical driving instructors in training institutions managed by local authorities.
