Highlights of the last week's documents (July 11 - July 17, 2022)

Here are some new remarkable documents that LawNet has updated from July 11 to July 17, 2022.

1. Addition of cases in which certificates of eligible for producing animal feeds are not mandatory to grant in Vietnam
 
This a  content of Decree No. 46/2022/ND-CP on amendments to Decree No. 13/2020/ND-CP elaborating the Law on Animal Husbandry.
 
According to the Decree, cases in which certificates of eligible for producing animal feeds are not mandatory to grant include:
 
-  Households and households businesses engaged in manufacture (production, preliminary and processing) of commercial traditional feeds;
 
- Food manufacturers meeting regulations of laws of Vietnam on food safety with food products and by-products created in the process of manufacturing foods suitable for use as animal feeds without going through any other preliminary or processing steps of such manufacturers. (New contents)
 
Decree No. 46/2022/ND-CP comes into force from July 13, 2022.
 
2. Instructions on using winnings in the foreign currency for prize-winning electronic games for foreigners in Vietnam
 
Governor of State Bank of Vietnam promulgated Circular No. 09/2022/TT-NHNN providing instructions on foreign exchange management for the business of prize-winning electronic games for foreigners.
 
According to the Circular, instructions on using winnings in the foreign currency for prize-winning electronic games for foreigners are prescribed as follows:
 
- In case players receive their winnings in foreign currency cash:
 
+ Players are allowed to sell their foreign currency cash to permitted banks to receive Vietnamese cash;
 
+ Players are allowed to transfer their winnings in the foreign currency cash overseas via permitted banks;
 
+ Players are confirmed to bring their winnings in the foreign currency cash overseas according to regulations in clause 1 Article 11 of Circular No. 09/2022/TT-NHNN by permitted banks;
 
+ Players are allowed to deposit their winnings in the foreign currency cash to their foreign currency accounts opened at permitted banks.
 
- In case players receive their winnings in the foreign currency via wire transfer:
 
+ Players are allowed to transfer their winnings in the foreign currency from corporations’ specialized foreign currency accounts according to regulations in Article 6 of Circular No. 09/2022/TT-NHNN to players' foreign currency accounts opened at permitted banks;
 
+ Players are allowed to transfer their winnings in the foreign currency from corporations’ specialized foreign currency accounts to players' accounts opened overseas.
 
Circular No. 09/2022/TT-NHNN comes into force from September 01, 2022 and replaces Circular No. 15/2014/TT-NHNN dated July 24, 2014 and Circular No. 11/2017/TT-NHNN dated August 30, 2017.
 
3. Values of complimentary tablets for school students from poor households in Vietnam
 
This is a content of Circular No. 09/2022/TT-BTTTT dated June 30, 2022 providing guidance on complimentary tablets and subsidization of public telecommunications services for using tablets under the Program of providing public telecommunications services by 2025, which comes into force from June 30, 2022.
 
According to the Circular, the values of complimentary tablets for beneficiaries are prescribed as follows:
 
- The values of complementary tablets are the bid prices according to the bidding results.
 
- The values of complementary tablets include expenses for transfer of these tablets to representatives of households in communes and expenses for warranty on the equipment.
 
In addition, Circular No. 09/2022/TT-BTTTT also prescribes principles for providing complementary tablets as follows:
 
- Each beneficiary is only allowed to receive one tablet and for one time;
 
- Beneficiaries and priority orders must be accurate based on the number of tablets under the Program;
 
- Beneficiaries of the Program must not be beneficiaries of other sources of the Program “Sóng và máy tính cho em”;
 
- Specific beneficiaries must be proposed publicly and democratically at establishments.
 
4. Instructions on opening accounting books for organizations that receive charity money in Vietnam
 
The opening of accounting books in case organizations, authorities and units that do not have particular accounting organizations for social and charitable activities receive charity money is prescribed in Circular No. 41/2022/TT-BTC providing instructions on accounting regimes applicable to social and charitable activities as follows:
 
- Units must fully record amounts of charity money received according to each real and specific contribution period of each donor.
 
Each unit must open a separate account at a bank or treasury to receive, allocate and use contributions to carry out social and charitable activities and must not use the general account with other activities of the unit.

In case the unit builds, repairs, preserves and recovers construction works from voluntary contributions, it must comply with relevant current regulations of laws.

- For the distribution and use of contributions to carry out social and charitable activities, units must fully record information on their accounting books, including: Time for payment, payment decisions, payment contents, name and address of donees. In addition:

+ In case of direct cash payment to the donees, lists and records used as the basis for that must be signed by the donees/recipients and certified by responsible units in their areas.

+ In case of payment for goods and exhibits used to donate or materials, payment for the construction and repair of construction works, legal invoices and records of purchase and sale must be involved as prescribed.

In case of direct donation of goods and exhibits to donees, lists with signatures of donees/recipients and confirmations of responsible units in their areas must be made.

Circular No. 41/2022/TT-BTC comes into force from September 01, 2022 and replaces Circular No. 103/2018/TT-BTC.
