1. Change of conditions for temporary suspension of contributions to the retirement and survivorship fund in Vietnam 

This is the content of Decision 33/2021/QD-TTg amending and supplementing a number of articles of Decision 23/20221/QD-TTg of Vietnam on the implementation of policies to support employees and employers facing difficulties due to the COVID-19 pandemic.

Specifically, employers who have fully paid social insurance premiums or are temporarily suspending contributions to the retirement and survivorship fund until the end of January 2021 are affected by the COVID-19 pandemic, resulting in a reduction from 10% of the number of employees participating in the labor force. Social insurance premiums or more at the time of application submission compared to January 2021 .

(Previously, it was required to reduce the number of employees participating in social insurance by 15% or more; the time of determining the number of employees to be reduced was compared to April 2021).

The reduced number of employees participating in social insurance includes:

+ Number of employees terminating labor contracts or working contracts in accordance with the law minus the number of new employees entering into labor contracts or working contracts in the period from February 1, 2021 until the date the employer has a written request.

(Previously specified in the period from May 1, 2021 to the date the employer has a written request).

+ Number of employees who temporarily suspend the performance of labor contracts or take unpaid leave but the period of suspension of the performance of labor contracts or unpaid leave is 14 working days or more in a month

+ Number of employees who are on leave but the time of stopping work is 14 working days or more in a month.

Decision 33/2021/QD-TTg of Vetnam takes effect from November 6, 2021.

2. Maximum payment rate for SARS-CoV-2 testing service in Vietnam

The Ministry of Health of Vietnam has promulgated Circular 16/2021/TT-BYT regulating the price of SARS-CoV-2 testing services.

According to the Circular, the price of SARS-CoV-2 testing service in case it is within the payment range of the Health Insurance Fund is as follows:

- Rapid test for SARS-CoV-2 Ag: 

The maximum payment is not more than 109,700 VND/test.

- Testing for SARS-CoV-2 by automatic or semi-automatic immunoassay machine:

The maximum payment is not more than 186,600 VND/test.

- Testing for SARS-CoV-2 by Realtime RT-PCR technique:

+ In case of application form:

The maximum payment is not more than 518,400 VND/test.

+ In case of sample pooling:

The maximum payment level shall not exceed the price of sample testing specified in column 2, Appendix I issued together with Circular 16.

Circular 16/2021/TT-BYT of Vietnam  takes effect from November 10, 2021 to the end of December 31, 2022.

3. Criteria for consideration for promotion to class II main lecturers at public universities in Vietnam 

This is the content of Circular 31/2021/TT-BGDDT of Vietnam stipulating standards, conditions for examination or consideration for promotion; content, form and determination of successful candidates in the examination for promotion to professional titles (CDNN) of teaching staff in pedagogical colleges and public higher education institutions.

Specifically, teaching staff in public higher education institutions may register to take the exam or consider promotion to the main lecturer's CDNN (class II), code V.07.01.02 when they fully meet the criteria and conditions:

- The public higher education institution has the need and is sent by the competent authority to participate in the exam or consider for promotion.

- Holding the lecturer's CDN (class III), code V.07.01.03.

- Being graded at the level of successfully completing tasks or higher in the working year preceding the year of taking the exam or considering promotion to the main lecturer's CDNN (class II), code V.07.01.02;

(Current regulations on successfully completing tasks within 03 (three) consecutive years up to the deadline for submission of application/consideration documents).

- Having good political qualities, good professional ethics, not within the time limit for disciplinary action...

- Having the capacity, professional qualifications and expertise to take on the task of primary lecturer (Grade II) foreign language CDN...

4. Validity of the free-sale registration number for medical equipment in Vietnam

The Government of Vietnam has promulgated Decree 98/2021/ND-CP on management of medical equipment.

According to the Decree, the effective regulation of the free-sale registration number of medical equipment is as follows:

- The circulation number of the medical device is valid for an indefinite period;

Except for the case that the free-sale registration number of medical equipment is issued according to the regulations on urgent issuance of the free-sale registration number of medical equipment in service of the prevention and control of epidemics, overcoming and consequences of natural disasters or disasters.

- Based on the actual dossier of the medical equipment requested for issuance of an emergency registration number, the Minister of Health of Vietnam shall decide the specific duration of the free-sale registration number.

(Currently, Decree 36/2016/ND-CP of Vietnam stipulates the free-sale registration number of type A medical equipment with indefinite validity; type B, C, D is valid for 5 years from the date of issue) .

Decree 98/2021/ND-CP of Vietnam takes effect from January 1, 2022.
