Guidance on Procedures for Issuance of Pink Books for Housing

Certificate of house ownership and land use rights (commonly referred to by the public as the "Pink Book") is the term used to designate the Certificate of House Ownership and Land Use Rights according to previous regulations. In order to be issued the Pink Book, citizens are required to follow the procedures stipulated by the law.

The procedure to issue the Pink Book is divided based on the timing of the application into the following 02 cases:

1. Pink Book issued for both the house and the land

Required documents:

- Application for registration, issuance of Certificate of land use rights, home ownership, and other assets attached to the land according to Form No. 04a/DK;- One of the types of documents stipulated in Article 100 of the Land Law and Article 18 of Decree 43/2014/ND-CP for cases of land use rights registration;- One of the documents stipulated in Articles 31, 32, 33, and 34 of Decree 43/2014/ND-CP for cases of registering ownership rights of assets attached to the land;- Proof of financial obligations; documents related to the exemption or reduction of financial obligations for land and assets attached to the land (if any);

Place to submit documents:

- The People's Committee at the commune level; or- The Office of Land Registration at the district level.

Processing time: No more than 30 days from the date of receiving the valid documents.

For mountainous, island, remote, or difficult socio-economic areas, the processing time is no more than 40 days.

2. Pink Book issued only for housing after homestead land has been issued with a Certificate

Required documents:

- Application for registration, issuance of Certificate of land use rights, home ownership, and other assets attached to the land according to Form No. 04a/DK;- One of the documents stipulated in Articles 31, 32, 33, and 34 of Decree 43/2014/ND-CP;- A diagram of the asset attached to the land (except for cases where the document of ownership rights of assets attached to the land already includes a suitable diagram);- The issued Certificate in cases of additional certification of ownership rights of assets attached to the land;- Proof of financial obligations; documents related to the exemption or reduction of financial obligations for assets attached to land (if any);- Written consent from the land user allowing construction of the work, notarized or certified.

Place to submit documents:

- The People's Committee at the commune level; or- The Office of Land Registration at the district level.

Processing time: Similar to the case of issuing the Pink Book at the same time for both the house and the land, it is no more than 30 days from the date of receiving the valid documents.

Currently, the names "Pink Book" and "Red Book" as per previous regulations have been consolidated under the name Certificate of Land Use Rights, Home Ownership, and Other Assets Attached to the Land. However, the public has become accustomed to the term Pink Book, so the procedure for the Certificate of Land Use Rights, Home Ownership, and Other Assets Attached to the Land is often referred to as the procedure for issuing a Pink Book.
