Age for Military Service
According to Article 30 of the Law on Military Service, the age for conscription is regulated as follows:
Citizens who are 18 years old may be conscripted; the age for conscription is from 18 to 25 years old; citizens who have been trained at the college or university level and have had their conscription postponed may be conscripted until the age of 27.
There are three important age milestones to note as follows:
- 18 years old;- From 18 to 25 years old;- Up to 27 years old for citizens trained at college or university level who have had their conscription postponed.
Thus, the age for military service currently ranges from 18 to 27 years old.
Guidance on Calculating the Age for Military Service
The age for military service must be calculated precisely by the day, month, and year. Citizen A's date of birth is dd/mm/yyyy, so the timeline for reaching the eligible age is calculated as follows:
- Turn 18 years old: dd/mm/(yyyy + 18)- Turn 26 years old: dd/mm/(yyyy + 26)- Turn 28 years old: dd/mm/(yyyy + 28)
Example: Tran Thanh Phong was born on June 25, 2000. The way to calculate Phong's age for military service is as follows:
+ Turn 18 years old: 25/06/(2000+18) = June 25, 2018
From June 25, 2018, Phong begins to be in the age for conscription.
+ Turn 26 years old: 25/06/(2000+26) = June 25, 2026
Thus, from June 25, 2026, Phong will be out of the conscription age (in the case of turning 26 years old).
+ Turn 28 years old: 25/06/(2000+28) = June 25, 2028
If Phong falls into the case of being trained at the college or university level and having had his conscription postponed, he will be out of the conscription age by June 25, 2028.
Note: In cases of evading military service, citizens may be subject to administrative fines or imprisonment. Specifically:
Administrative fines up to 4,000,000 VND for evading military service
According to Articles 4, 5, 6 of Decree 120/2013/ND-CP by the Government of Vietnam stipulating administrative penalties in the field of national defense, cryptographic work, the penalties for some acts of evading military service are specifically regulated as follows:
- Not registering for military service for the first time: Fine from 200,000 - 600,000 VND and compelled to register for military service.- Failing to appear at the time or place for preliminary selection for military service stated in the preliminary selection call without a valid reason: Fine from 500,000 - 1,000,000 VND and compelled to undergo the preliminary selection for military service according to the plan of the Military Service Council.- Failing to appear at the time or place for health check stated in the health check call for military service without a valid reason: Fine from 800,000 - 1,200,000 VND and compelled to undergo the health check according to the plan of the Military Service Council.- Dishonestly causing an incorrect health classification result to evade military service: Fine from 2,000,000 - 4,000,000 VND and compelled to undergo the health check again for military service.- Failing to appear at the time or place for conscription stated in the enlistment order without a valid reason: Fine from 1,500,000 - 2,500,000 VND.
May be imprisoned up to 5 years for evading military service
According to Article 332 of the Penal Code, anyone who does not comply with the legal provisions on military service registration, conscription order, or training call, after having been administratively penalized for such acts or having been convicted of this crime and not yet forgiven but still commit it, shall be punished by a non-custodial reform sentence up to 2 years or imprisonment from 3 months to 2 years.
In the case of committing the crime with acts of self-inflicting injury or causing harm to one's health; committing the crime during wartime; inciting others to commit the crime, shall be imprisoned from 1 year to 5 years.
