On August 22, 2012, the Ministry of Natural Resources and Environment issued Circular 09/2012/TT-BTNMT regulating the provision and exchange of information and data on genetically modified organisms.
What is the database of genetically modified organisms in Vietnam? (Illustration Image)
According to Article 3 of Circular 09/2012/TT-BTNMT, the database of genetically modified organisms is a collection of data about genetically modified organisms stipulated in Clause 1, Article 2 of Circular 09/2012/TT-BTNMT that has been checked, evaluated, processed, integrated, and systematically stored and organized in the form of data files on computer systems, storage devices, and information carriers such as computer hard drives, magnetic tapes, CDs, DVDs, or documents maintained for the purpose of state management and activities in economy, society, national defense, security, scientific research, education, and raising public knowledge. Specifically, information and data on genetically modified organisms include:
- Bilateral and multilateral agreements related to biosafety of genetically modified organisms that Vietnam participates in or signs;
- Current legal regulations on biosafety of genetically modified organisms;
- Results of programs, projects, scientific and technological research subjects on biosafety of genetically modified organisms kept by competent management agencies;
- Biosafety Certificates, Confirmation Certificates for genetically modified organisms eligible for use as food, Confirmation Certificates for genetically modified organisms eligible for use as animal feed, Genetically Modified Organism Testing Permits; Decisions recognizing testing results, Decisions recognizing and revoking recognition of laboratories researching genetically modified organisms, Decisions recognizing and revoking recognition of genetically modified organism testing facilities; Lists of genetically modified organisms allowed for use as food, animal feed, and released into the environment; permits or decisions for importing genetically modified organisms not on the list of genetically modified organisms allowed for use as food, animal feed, and released into the environment;
- Reports including: reports as stipulated in appendices I, II, III, IV, and V issued together with Decree No. 69/2010/ND-CP dated June 21, 2010, of the Government of Vietnam on biosafety of genetically modified organisms, genetic specimens, and products derived from genetically modified organisms; reports on inspection and handling of inadvertent transport cases of genetically modified organisms; reports on inspecting, handling, and remedying risks related to genetically modified organisms;
- Information on: testing of genetically modified organisms; area of genetically modified crops, cases of risks, and handling measures; lists of experts in biosafety and modern biotechnology inside and outside the country; other information and data related to genetically modified organisms.
Additionally, Circular 09/2012/TT-BTNMT also stipulates that the database of genetically modified organisms includes:
- The national database of genetically modified organisms (hereinafter referred to as the national database) developed, stored, and managed by the Ministry of Natural Resources and Environment;- The sectoral database of genetically modified organisms (hereinafter referred to as the sectoral database) developed, stored, and managed by Ministries, Ministry-level agencies, and agencies under the Government of Vietnam;
- The local database of genetically modified organisms (hereinafter referred to as the local database) developed, stored, and managed by People’s Committees of provinces and centrally run cities (hereinafter collectively referred to as Provincial People’s Committees);
